Mexico > Dispute resolution: litigation Tier 1

Powerhouse dispute resolution boutique Malpica, Iturbe, Buj y Paredes, S.C. is seen as ‘an ally of its clients’ and its litigation offering in particular is of considerable repute, a regular fixture in the most complex cases in the Mexican market. Standout recent engagements have seen the firm represent a number of energy companies in amparo lawsuits and constitutional reviews against the Mexican government’s reforms in the sector. In the finance sector, the team is well-versed in representing leading international and domestic banks in contentious matters, while -more broadly- antitrust and telecoms disputes have also been recent areas of activity. Clients highlight and value the ‘professionalism, values and practical solutions’ of senior partner Carlos Malpica, who worked with further key partners Horacio Paredes and Juan José Iturbe on a number of the aforementioned energy sector cases. Rodrigo Buj has acted in high-profile telecoms and antitrust matters in recent years, while Alvaro Huerta is the name to note for IP litigation. María José Jimenez is an administrative and antitrust litigation expert, and Fernando de Ovando is another strong commercial litigator. At associate level, key seniors Alejandro Agredano (administrative & commercial litigation) and José Luis Vergara Estrada (civil & commercial litigation), are the names to note. Since publication the firm has made a high-profile incorporation with the hire of White & Case S.C.'s former managing partner, disputes specialist Ismael Reyes Retana - effective as of January 2024.

Testimonials

The best possible human treatment. The team shows true professionalism and excellent communication.

Clear strategies with serious considerations regarding the risks they entail.

It is a firm specialised in complex litigation and arbitration. Their multidisciplinary team sets them apart from other dispute law firms by analysing issues from various contentious perspectives, with a deeply technical focus, but without leaving aside the practical considerations necessary to obtain favourable results for the interests of the companies they represent. Their strong team composition is also an important differentiator. The team includes partners with a lot of experience in litigation, as well as junior partners and junior associates who are handling the cases. Junior and senior lawyers are of various profiles, people with studies in the best universities, all bilingual, all trained in MIBP or hired laterally from other important litigation firms in the market. I also know that they have an associate exchange system, which allows almost all associates with a master’s degree to have work experience outside of Mexico. As an in-house lawyer, we like their expertise in various contentious matters, their reaction to requests for reports, the service, and the empathy they seek to generate with their clients.

I work directly with Rodrigo Buj García and Juan José Iturbe, both founding partners of the firm. They assist us in disputes against banks and in another dispute against a leading company in the mining and metals sector. Both partners complement each other very well due to their experience and procedural technique to litigate in local and federal courts (Juan Iturbe), as well as their sharpness in handling matters and their litigation strategy (Rodrigo Buj).

I believe that what makes them unique is that they are a boutique specialised in litigation and arbitration, which makes them focus on their practice, but with a corporate and transactional approach, since most of their lawyers have knowledge of these areas from their past experience, which helps them understand the problem in a holistic way so they can fully prepare arguments for the litigation.

We admire their background in other legal specialties such as corporate law and the personalised customer service.

The Malpica team is a highly-qualified team that understands the needs of the business, always looking for practical solutions and aware of the needs of companies and avant-garde. It seeks creative solutions that differ from other law firms and also has a new collections area that is totally innovative for a top tier law firm like them, because it allows competitive prices while having a high quality service. They are an ally of their clients.

They are highly qualified lawyers who seek practical and creative solutions, always demonstrating very high values, which distinguish them in the market. All of them have a friendly manner, responding with rapidity and excellent disposition. I highlight Carlos Malpica, with whom it is a delight to work due to his professionalism, values and practical solutions. And also Rolando Zarate, who has a lot of technical knowledge and availability to support the client. Overall its a high quality service that adds value to its customers.

Mexico > Dispute resolution: arbitration Tier 2

Arguably best known as a litigation boutique, the arbitral capability of Malpica, Iturbe, Buj y Paredes, S.C. is sometimes overlooked, but the firm handles a significant caseload of sizeable and strategically significant arbitrations – institutional or ad hoc – including investment arbitrations subject to international treaties. The firm saw exponential growth of its commercial arbitration practice during 2022, and is currently involved in two ongoing investment arbitrations against Mexico, with a further two cases -one NAFTA, one Brazil-Mexico BIT- in prospect. The team also hanldes all the different judicial proceedings related to arbitration, including those related to interim measures, claim referrals, and annulment and enforcement proceedings.  Recent matters have seen commercial and ICC arbitrations expert Rolando Zarate and senior partner Carlos Malpica acting for Exterran Energy de Mexico and Exterran Energy Solutions in a $600m case against Iberoamerciana de Hidrocarburos for payments related to agreements for the conditioning a gas plant in Tamaulipas; the pair are described as ‘highly prepared lawyers, capable of proposing creative strategies and thinking "outside the box" in complex cases’. Zarate is also acting with energy disputes specialist Horacio Paredes in seeking the annulment -on behalf of Mayakan- of a MXN$110m award granted to the CFE for payment of natural gas transportation services (the case rests on the interpretation of the arbitral agreement and its relation to Mexican public policy in the energy sector); the ‘very capableJuan José Iturbe in a MXN$250m ICC arbitration initiated by DAS against Tesla Energy to obtain payment of several amounts related to a stock purchase agreement; and Rodrigo Buj, in commercial arbitration initiated by FV Mexsolar against the CFE regarding the termination of an energy sale and coverage agreement. Buj's standing in arbitral matters was highlighted in 2022 with his appointment by White & Case LLP  (NY Office) as Mexican Law expert in an investment arbitration against Mexico.

Testimonials

They have a team capable of developing effective litigation strategies in commercial and governmental fields.

The team has an sizeable structure and is suitable for a boutique law firm specialising in disputes. Juan Jose Iturbe is the partner with whom I have shared the most and he is very capable and focused on business.

I believe that what makes them unique is that they are a boutique specialised in litigation and arbitration, which makes them focus on their practice, but with a corporate and transactional approach, since most of their lawyers have knowledge of these areas from their previous experience, which helps that they fully understand the problem and in a holistic way can prepare arguments for the litigation that they prepare.

Personalised attention and background and knowledge of other areas of law such as corporate law.

MIBP is the firm in Mexico with the best quality of litigation/arbitration lawyers. Carlos Malpica and Rolando Zarate are highly prepared lawyers, capable of proposing creative strategies and thinking “outside the box” in complex cases.

There is no other law firm in Mexico that has so many good litigants under the same roof.
