Position

Daniel Posse is a founding partner of Posse Herrera Ruiz and leads the ADR and litigation practice area. He specializes in dispute resolution, having participated in international and local arbitrations.

Career

As a dispute resolution expert, he has acted as attorney and arbitrator in numerous national and international arbitration proceedings. For over twenty-five years he has handled more than 3,000 lawsuits.

He is member of the Colombian Arbitration Committee, the ALARB Committee of Relations with State Entities and Colombian Institute of Procedural Law. He is a registered arbitrator in the Bogotá Chamber of Commerce Arbitration Centre, Asomagister and the Arbitration Center of the Colombian Superintendency of Corporations.

He has a JD from Universidad Javeriana.

Co-led by senior partners Jaime Herrera and Daniel Posse – corporate and litigation specialists, respectively, both have considerable competition expertise – Posse Herrera Ruiz’s practice has extensive experience advising clients in all sectors of the economy, in competition law, antitrust regulation, M&A-filings and associated contentious matters. The 4-lawyer team also includes associates Juan Pablo Bonilla and Hernán Panesso and recently advised Jerónimo Martins in antitrust matters related to its establishment of a Colombian operation, including the expansion of its retail outlet business – a mandate involving 10 merger clearances over the past year. Other work saw the team assist Tronox obtain antitrust clearance for its acquisition of Cristal’s titanium dioxide business. Other clients include Seguros Bolívar, Diageo, Saint-Gobain and Automotores Toyota de Colombia.

With a strong track record in construction arbitrations, Posse Herrera Ruiz continued to assist international law firm King & Spalding LLP in the cross-border ICC arbitration brought by Refinería de Cartagena (Reficar) against an American contractor for breach of an EPC contract for the $8bn construction and refurbishment of the refinery. The case is led by practice head Daniel Posse. María Lucía Posada is representing CEPSA, a Spanish oil and gas company, in a domestic arbitration filed by Termotécnica Coindustrial regarding a $12m breach of contract for the construction of oil and gas facilities. Carolina Posada is acting for the Brazilian and Colombian subsidiaries of Blau Farmaceutica in an international arbitration filed by previous minority shareholders of Blau Farmaceutica for an alleged rights infringement deriving from an alleged abuse of its dominant position in the payment of dividends.

Founding partner Daniel Posse, whose expertise in the field is ‘unrivalled’, co-leads Posse Herrera Ruiz’s 20-strong team along with Carolina Posada, who is ‘thorough, accurate, strategic, a true out-side-of the box thinker’. Clients point to proportionate costs, in terms of quality and results, the disposition of the four partners, attending directly the matters, and the integrity and ethics with which the cases are conducted. The practice undertakes corporate and commercial disputes, constitutional actions and administrative litigation. It is representing Toyota in a case against a former distributor, and Fundación Social in a case against its co-investors in a pharmaceutical project. Other matters include advising a mining company regarding a constitutional action that affects the viability of one of its projects and representing a multinational retailer regarding a regulatory fine. María Lucía Posada is also highly recommended; she is advising mining company South 32’s Cerro Matoso subsidiary on administrative proceedings that seek to annul enacted regulations which established the retroactivity of nickel royalty payments for the group’s Colombian mines.
