With particular strength in complex contentious and administrative law matters, public law boutique Esguerra Asesores Jurídicos is noted for advising both state entities and private local and multinational corporations across all main public law regulatory sectors. The highly recommended Juan Carlos Esguerra and Felipe Piquero (who is also an experienced litigator) co-lead a team that advises on all aspects of public law matters – from litigation before the administrative instances and arbitral tribunals, to structuring projects and public bids. Associate director of the public law practice Adriana Nieto has experience advising clients on public procurement processes, the design of public contracts and consulting on infrastructure projects, along with expertise in anti-corruption matters. The team is further instructed by government entities regarding administrative and public law issues and is currently acting as legal advisor to the Ministry of Transportation on the legal structuring of the new concession that will operate the RUNT project, the largest project structured -and to be entered into- by said Ministry.
Red Legal Iberoamericana-member for Colombia, Esguerra Asesores Jurídicos ‘is a firm that has a team with great availability, speed and depth of analysis; it’s constructive, works collaboratively and, above all, anticipates‘ developments. Highly sought after for its deep expertise in both private and public law disputes, it has an impressive track-record in contentious administrative, constitutional and public law matters. The 10-strong litigation group works transversally across sectors (corporate, public contracting, projects, etc) as required, and is a favoured choice for a broad range of disputes work (albeit excluding civil or labour litigation), from corporate and financial disputes and fiscal liability matters, to administrative challenges and litigation regarding environmental permits. The practice has also developed a reputation for work with a high technical element (the Hidroituango matter being a case in point), particularly in the energy sector, where it has also won multiple tariff dispute cases. Founding partner Juan Carlos Esguerra has a lengthy private practice trajectory in both litigation and arbitration, as well as senior judicial posts – most notably as conjuez of both the Consejo del Estado and the Constitutional Court. He co-leads the practice with Felipe Piquero (‘great capacity for listening, vision and strategy‘; ‘judicious and considered – a very fine lawyer‘), whose practice centres on public procurement-related litigation along with matters of domestic and international state-responsibility; and Andrés Jaramillo whose administrative litigation practice takes in unfair competition and restrictive practices, merger-related matters, commercial disputes and state contracting – he also has niche expertise in the maritime ports segment. Associate practice directors Andrés Felipe Cadena (litigation) and Adriana Nieto (public law) are also key practice members. The team was strengthened with the June-2020 arrival of associate Paola Patarroyo but November-hire, Ana María Herrera, left in May 2021 to undertake her LLM.
Fielding a 13-strong disputes team led by three partners, Esguerra Asesores Jurídicos distinguishes itself not only by the depth of its regulatory and public law knowledge, but also by its exclusive focus on domestic arbitral matters – primarily those related to public contracts and infrastructure. As a former Minister of Justice, name partner Juan Carlos Esguerra was responsible for the commission that originated 2012’s Law 1563, which regulates both domestic and international arbitration in Colombia; deeply experienced both as counsel and arbitrator, he is particularly noted for his negotiation skills. ‘Judicious and considered’ and ‘a very fine lawyer‘, Felipe Piquero acts primarily in cases related to public contracts, domestic and international state-responsibility, and human rights law; and Andrés Jaramillo Hoyos focuses on commercial and administrative contractual matters, and also has niche expertise in port-related issues. Headline mandates include advising Hocol on the initiation of arbitral proceedings against oil-drilling equipment company Adrialpetro for provision of faulty and/or insufficiently sensitive equipment for the measuring of oil-well productivity, with an estimated value of over COP$44bn. Other matters include disputes regarding alleged breaches in a ship-and-pay contract in the hydrocarbons transportation segment; and proceedings concerning multiple breaches of contract in the agricultural sector. Following the June-2020 departure of María Cristina Martínez, Paola Patarroyo, has replaced her as associate arbitration practice director; a former international associate at Freshfields’ arbitration group, Patarroyo has experience of proceedings under ICSID, ICC and UNCITRAL rules. Further depth comes from November-2020 hire (from Transmilenio), Ana María Herrera, who has notable arbitral experience.
Competition and public law specialists Esguerra Asesores Jurídicos‘ corporate and M&A area fields five expert partners, and clients highlight their ‘personalised attention‘, ‘very good quality of service‘ and willingness ‘to be creative in the search for solutions to the problem‘. As might be expected, the partner-heavy team is particularly known for made-to-measure, tailored advice. Late 2018-hire Andrés Parias -formerly at the Superintendence of Securities- is fully focused on corporate matters; he and Juan Pablo González (corporate, finance, capital markets and M&A) lead on the majority of matters but can also call of fellow co-heads Alfonso Miranda, Felipe Piquero and Andrés Jaramillo, each of whom are highly reputed in their specialist areas of competition, litigation and antitrust, respectively. Recent matters include advising Cummins Colombia on the winding up of its operations; Servicios Postales Nacionales on a $23.4m capitalisation process from the Government; and permanent legal advisory on corporate matters to the Cámara de Riesgo Central de Contraparte de Colombia and the Cámara de Compensación de Divisas de Colombia. Key associate support comes from Nicolás Arocha-Roldán.
The team at Esguerra Asesores Jurídicos primarily handles the structuring of infrastructure and technology projects, advising on the structuring of concession agreements related to software and computer services and technology, and hardware and electronics, along with assessing clients regarding public bids. Felipe Piquero (who is active in arbitration, particularly as regards airport concession cases, as well as public procurement and PPP projects), co-heads the team alongside Juan Carlos Esguerra and Andrés Jaramillo Hoyos. With his focus on project finance, Juan Pablo González is also a name to note, and public law practice director Adriana Nieto is a further integral member of the team. Recent highlights include advising PAYC with regards to legal inquiries, administrative sanction procedures and auditing contracts for construction agreements.
