Main areas of practice

Competition and Antitrust: the firm has recognized and solid know-how in assisting clients in all aspects of Competition Law. GCA’s experience specifically includes dealing with (i) complex mergers and acquisitions, horizontal mergers, vertical integrations, joint ventures, associate agreements, and challenges to transactions before the Brazilian Antitrust Authority (“CADE”); (ii) administrative proceedings before CADE and/or lawsuits before the Judicial Courts in matters related to infringing conducts, such as cartel prosecution, refusal to sell, sham litigation, price discrimination, resale price imposition, predatory or abusive pricing or conducts; (iii) preventive assistance and advisory services; and (iv) preparing and implementing compliance programs within these matters. The firm is also frequently selected to represent clients present in challenging, niche, and/or innovative industries, including search engines, marketplaces, internet and telecom services providers, and technology, evidencing the team’s ability to work in those markets.

International Trade and Customs: GCA actively represents the domestic industry, importers, exporters, associations, and governments in antidumping, subsidies, and safeguard investigations, as well as tariff changes, including the List of Exceptions to the Common External Tariff – LETEC. The firm also works extensively in providing legal services to clients before (i) the Ministry of Development, Industry and Commerce – MDIC; (ii) the Chamber of Foreign Trade -CAMEX; (iii) and the Ministry of Finance, more precisely the Office of Economic Supervision – SEAE; as well as preparing advisory services and consultation in foreign trade. Intellectual Property and Entertainment:the firm’s intellectual property area assists clients in managing and protecting intellectual property assets in Brazil such as trademarks; domain names; industrial designs; copyrights; geographical indications; software; trade secrets; technology transfers. The services rendered include consultancy and assistance in negotiating IP and franchising agreements with assistance before the Brazilian Patent and Trademark Office. GCA also advises on niche areas such as Biodiversity Law, Fashion Law and Entertainment with expertise in laws and regulations applicable to the entertainment industry, including acting on acquisition agreements, production agreements, sponsorship and advertisement as well as representing clients before regulating and self-regulating authorities such as the Brazilian Cinema Agency – ANCINE and the Brazilian Advertising Self-Regulatory Council.

Technology and Data Protection: the area focuses on advising clients in technology related matters and regulation in Brazil, including data protection, privacy, internet and information security matters, assisting on drafting agreements, policies and compliance terms in accordance with Brazilian laws. The firm is also organized to render legal services in the structuring of start-ups, websites, e-commerce platforms, drones and internet connected devices (IoT) in Brazil.
