Dispute Resolution
Insolvency and Restrcuturing

Senior associate at Morales & Besa.

Mr. Palominos has more than a decade of experience in dispute resolution, which he has focused in arbitration, litigation and insolvency matters. In parallel, he has been professor and assistant professor of civil law, legal practice and legal ethics, which have granted him a practical and theorical approach that is praised by his peers and clients.

He has devoted most of his time to arbitration mandates, particularly in the field of complex, high value and multi-party construction disputes; in which he has managed large teams and the different relationships between counsel, client, expert witnesses and the arbitral tribunal. He has also shown great abilities to understand and cope with the multidisciplinary consequences of this kind of controversies and their impact over the different contractual relationships that surround them; such as finance schemes, shareholders agreements, concession contracts, etc.

His methodological and detailed approach to the management of controversies has allowed him to routinely represent public works concessionaires in their disputes against the Ministry of Public Works, contractors and sub-contractors in construction related controversies, being directly involved since the beginning of controversies, during negotiations and, lately, proceedings before dispute boards, local courts and arbitral tribunals.

During such practice, he has shown a noteworthy strength in the knowledge and application of the law to complex disputes that demand creative and multidisciplinary approaches to provide the best possible solutions to our clients.

In addition, the remarkable strengths of Mr. Palominos has allowed him to assume a key role in our insolvency and restructuring practice, being the go-to associate to address any issues regarding Chilean insolvency law and, particularly, cross-border insolvency mandates. In such a capacity, Mr. Palominos has been involved in most of the Chilean current cross-border insolvency issues and in some of the most relevant reorganization proceedings followed before local courts.
