Position

Partner. A specialist in commercial and corporate law, he has worked on a number of complex matters, advising local and international firms on the restructuring of debts, the sale and purchase of bankrupt companies and similar cases. He has also been involved in solving corporate conflicts including cases taken to independent arbitration.

Career

He worked in the National Civil Law Courts (1989-1993) and in different law firms in Buenos Aires, specializing in commercial matters, up to the time he rejoined the National Courts as Secretary in charge of Secretariat #8, in the National Court of First Instance (Commercial) #4 (1998-2003). He joined Allende & Brea in 2003 and was named partner of the firm in December 2005.

Allende & Brea’s comprehensive practice, which is led by Enrique Cristian Fox, is equally adept at advising both debtors and creditors on insolvency matters. Among its recent work for the former, it advised the Argentine companies of Codere Group on the restructuring of $1.5bn worth of debt. Among the team’s creditor mandates, it represented Standard Chartered Bank on the liquidation of Banco General de Negocios.

David Gurfinkel steers a diverse group at Allende & Brea, which has broad expertise in commercial litigation, IP disputes and environmental claims. Class actions are a notable sweet spot and Gurfinkel recently represented MetLife in several lawsuits filed by consumer protection associations. The team also successfully defended Syngenta Agro in a case alleging environmental damages derived from the use of PET packaging ¬– Gurfinkel teamed up with Enrique Cristián Fox and environmental specialist María Morena Del Río to lead that work. The department has also recently undertaken work for BBVA Banco Francés, Chubb Argentina de Seguros and Solvay.
