Ariela’s practice focuses on litigation, arbitration, unfair competition, antitrust advertising law and inte- llectual and industrial property, including trademarks, patents, copyright, information technologies and licensing.

Major publications and rankings such as Chambers & Partners, Best Lawyers, World Trademark Review, Managing Intellectual Property and IAM regularly distinguish Ariela’s outstanding work. This year she was singled out as a Leading Lawyer by Legal 500 and in 2016, she was listed among the world’s Top 250 Women in Intellectual Property by the prestigious ranking IP Stars of Managing Intellectual Property.

She is a lawyer from the University of Chile and has a Master of Laws from Florida’s St. Thomas University, and was until December 2016 President for the Americas of the Global Advertising Lawyers Alliance (GALA). She is an Ethics Judge at the Chilean Bar Association and also an active member of the International Trade- mark Association (INTA) where she is currently Chair of the Committee on Emerging Issues and was also the Sub Committee Chair on Legislation and Regulation for Latin America. She is also a member of the latter Committee of the Inter-American Association of Intellectual Property (ASIPI).

Chile > Consumer and advertising law

A founding member of the Global Advertising Lawyers Alliance, Albagli Zaliasnik‘s six-strong consumer and ad-law team is headed up by trade mark and patent specialist Eugenio Gormaz (promoted to partner in May 2020), alongside Óscar Molina (director of the firm’s IT, media and data privacy group), who also has significant experience in advertising issues, entertainment-industry regulation, advertising law and consumer protection. IP specialist and senior partner in charge of dispute resolution Ariela Agosin is also regularly involved in key cases involving advertising and consumer law. Assisting with both consumer law-related litigation and corporate work, Dafne Guerra was promoted to senior associate in mid-2020, while the group’s other notable associates include senior Juan Pablo Zamora and intermediate Gonzalo Bravo.

Chile > Dispute resolution: litigation

Albagli Zaliasnik‘s 14-strong civil and arbitration team acts for major national and multinational businesses and individuals throughout the LatAm region (and beyond) in complex, high-stakes dispute resolution. Representative work includes disputes between individuals, high-value conflicts involving corporations, and administrative, criminal, and constitutional law-related matters. International law and civil and commercial litigation expert, Ariela Agosin, heads the civil litigation and arbitration group, as well as the competition, antitrust and regulatory group, while maintaining a strong presence in the IP department. Senior associate Félix Antolín, whose practice includes civil, commercial, economic and natural resources-related litigation, is director of the group, which also includes litigator Francisco Fuentes, who was promoted to senior associate in May 2020.

Chile > Intellectual property

Providing ‘comprehensive advice and expertise’, Albagli Zaliasnik‘s IP department is particularly well known for its expertise in anti-counterfeiting, complex IP litigation, and patents and trade mark prosecution, as well as advertising law. In May 2020, IP group director Eugenio Gormáz, a trade mark, copyright and patent specialist, was promoted to partner; nevertheless, senior partner and civil litigation and arbitration head, Ariela Agosin, also maintains a strong IP group presence. Additional practitioners integral to the group include: IT, privacy and media practice director, Oscar Molina, who assists with the protection and defence of IP assets; and three experienced associates – namely Andrea Céspedes, and litigation-and-contracts experts Juan Pablo Zamora and Antonia Nudman.

Chile > Competition and antitrust

Albagli Zaliasnik‘s competition law, regulation and public law group is particularly experienced in matters where competition, IP and the digital economy come together; its representative work includes antitrust compliance programmes, merger control and investigations before the FNE, as well as TDLC and Supreme Court trials. The practice is co-led by name partner Gabriel Zaliasnik, whose litigation caseload includes antitrust cases; and Ariela Agosin, who, in addition to litigation, regulatory and IP work, advises pharmaceutical and telecoms clients on antitrust matters. Other key practice members include Daniel Lopez (pharmaceutical and medical devices’ sector expertise); and senior associates Matías Edwards (who re-joined from the FNE in September 2020), recently promoted Dafne Guerra (regulated markets, free competition and public economic law), and Antonio Rubilar (investigations before the antitrust authorities).

Chile > Life sciences

Albagli Zaliasnik‘s seven-member department fields experts in the pharmaceutical (human and veterinary), biotechnology, food and beverage, agro-industrial and pesticide industries. Representative work includes administrative and sanitary registrations, as well as complex litigation processes, patent-related filings and prosecution issues. The practice also assists with obtaining authorisations for the commercialisation of pharmaceutical products and medical devices, along with acting before the Health and Drug Authorities. While maintaining a strong IP practice, senior partner Ariela Agosin leads the life sciences group alongside IP director Eugenio Gormáz, who was made partner in May 2020. Also integral to the practice are Daniel López (competition law, regulation and public law head); and senior associates Dafne Guerra (promoted in mid-2020) and Matías Edwards, who re-joined the firm in September 2020 from the National Economic Prosecutor’s Office.
