They are involved in many of the transactions in Canada, which is reflective of the quality of service they provide, but this also puts them in a position to give us the best advise and service on the transactions we engage them on as they have the most knowledge of what is happening in the marketplace. They are our trusted advisors, strong advocates for us on any matters on which they represent us as counsel, and are able to deliver top quality service that is second to none.’
‘I primarily deal with their securitization lawyers, many of whom are the top securitization lawyers in Canada. Marc MacMullin, senior partner there and head of their financial services group and Dean Masse, partner in their securitization practice are two partners that stand out in particular. They are both incredibly intelligent and thorough. They are very strong negotiators who tirelessly advocate for my best interests as their client. They do a great job identifying and addressesing any legal or business points and explaining it to us in a way that is easy to understand so that we fully appreciate the risks and can get comfortable that they are appropriately mitigated. In addition to Marc and Dean, Chris Bamford is a stand-out associate. He is by far the strongest securitization associate that we have worked with in Canada. The firm has also demonstrated its strengths in a range of market segments, including mining, retail, private equity, and energy. Leveraging these broad capabilities, the firm has recently been involved in transactions involving Africa, Australia and the Asia Pacific region, the Middle East, and Latin America. The firm's international reputation also wins it regular referrals from businesses and law firms alike, with the firm’s key team members often being called in to assist with major international deals in their focus areas. Shea Small is one such key team member; he co-leads the firm’s international practice and works between Toronto and London. Small is very experience in the Asia Pacific mining sector, where he acts for Chinese investors, Australian mining companies, and investment banks. Vancouver-based Asia group chair Joyce Lee also works regularly with Chinese investors and companies looking to expand into Canada. Lee’s recent work has included joint ventures and minority investments, takeovers, and M&A. Christopher Langdon co-leads the projects team in Toronto and London, and is widely recognized as a project financing and commercial specialist, having advised financiers and sponsors on large-scale financing arrangements for projects in Canada, Africa, and the Middle East. Also in London, office managing partner Robert Brant has maintained a strong reputation in the corporate and M&A space, advising clients in several industries with a particular focus on energy and natural resources. Karl Tabbakh was appointed co-head of the international team in 2019, combining the role with his position as managing partner of the Montréal office. Tabbakh has extensive experience in the Middle East, having previously practiced in Abu Dhabi. Another key figure for international transactions is Matthew Cumming, head of the firm’s New York office and an experienced private equity lawyer. Cumming co-ordinates strategy in the US and is close to the firm's key private equity clients such as Orocobre, OMERS, and Slate.
‘The team is very well integrated, in the same office and also between offices in Canada and elsewhere. The partner in charge follows closely the matter at stake, but delegates work to professionals having the right level of experience and expertise. They have expertise in a wide range of sectors, making it a one stop shop. In addition, they have relations with law firms all around the world and can therefore work closely with them and monitor their work, as if it was the same firm.’
‘Karl Tabbakh, a partner, is a great advisor. He follows closely the matters in which he is involved and can give good advice, including from a business perspective. He thinks about you even when you don’t think about him. Having been involved in many material transactions, all around the world, he knows his stuff and is reassuring. You know that he cares and that you can trust him. All of the junior partners and associates working with him are built from the same mould and it is something that you appreciate.’

Public procurement Tier 3
McCarthy Tétrault's procurement group 'has extensive experience in public procurement in a variety of markets' and is rated by clients for its ability to effectively 'drill down the most essential changes worth debating with a public authority'. Acting both for public and private entities, the team also benefits from its ability to draw on the firm's wider industry groups in a range of areas, particularly project finance. The department also has a growing procurement litigation practice handling bid disputes. Calgary-based practice head Catherine Samuel has particular experience in the areas of energy, telecoms, technology, retail and financial services.
‘The McCarthy team has extensive experience in public procurement in a variety of markets. As such, they are able to both (a) advise on risk allocation changes that have a potential to be considered/effected (in more mature markets), and (b) draw examples and experience from other markets to effectively sell new approaches (in less mature markets). In any event, they are able to drill down the most essential changes worth debating with a public authority, avoiding time consuming and aggravating lengthy and unfruitful reviews of comments.‘
‘Anca Neacsu is well-respected by her peers amongst partners, including public authorities. Her deep experience, credibility and hard work make her an ideal business partner.‘
‘It was a pleasure to work alongside Anca, she was simply superb while we had to combat this other large competitor who pulled out every trick in their arsenal. We persevered in the legal and commercial discussions with an end result of us winning the pilot and being selected as the vendor. Anca added significant value in the strategic work at the beginning and very much so during the business case phase where the client brought in an outside consultant for an NPV analysis. With Anca’s support we ended up improving our position. The relationship we formed with Anca and McCarthy is what we deem a true partnership and she has set the bar high for our other partners in other countries.‘
