Winston & Strawn LLP's IP practice has a strong track record in copyright disputes. Michael Elkin and Thomas Lane are the two key names to note and together they acted for Cox Communications in a dispute brought by music publishers which argued that the client was responsible for its subscribers infringing the plaintiffs' copyrighted material. Elkin also represented Pepsi in a claim by advertising agency Betty, which alleged that the client's 2016 Super Bowl commercial was based upon a concept pitched by the agency.

The team at Winston & Strawn LLP 'always rolls up its sleeves to get through thorny projects'. Known as 'consistent, trusted, and reliable advisers', the practice group comprises 'very effective litigators'. Defense instructions, especially from generics pharmaceutical clients, account for a significant portion of the caseload, but the group also demonstrates strength in the wider life sciences, energy and technology sectors. Chicago's George Lombardi led the joint defense group for Watson Pharmaceuticals in a major victory over Amgen, which had filed a patent infringement claim regarding the only non-expired patent covering its blockbuster drug Sensipar. Other work came from Chamberlin Group, Sandoz and medical device player Alphatec Holdings. The 'smart, insightful and hard-working' Krishnan Padmanabhan, who splits his time between New York and Silicon Valley, has 'exceptional client management skills' and 'has developed a reputation for excellence'. Washington DC's Charles Klein, David Enzminger, based in Los Angeles and Silicon Valley, and Thomas Patrick Lane in New York jointly lead the practice group. Kurt Mathas and newly promoted partner Bryce Cooper in Chicago are also noted. Esha Bandyopadhyay joined Fish & Richardson P.C. while Sam Park joined Hikma Pharmaceuticals.
