The firm acted for Omnicare in a class action in the Supreme Court, which ruled in favor of the defendant in one of the most¬†important ‚Äė33 Act decisions of recent years. The case overturned the Sixth Circuit's judgment that¬†a claim based solely on a statement of opinion need only allege that the opinion turned out to be wrong.¬†John Schreiber¬†in Los Angeles, and, in New York,¬†James Smith¬†and¬†Richard Reinthaler¬†were the key partners involved. Practice head Smith¬†is described by clients as 'an exceptionally good lawyer - highly attentive to both the details and the big picture strategy'. The practice is noted for its 'ability to adapt to changing strategy as needed'. Reinthaler is currently representing¬†Macquarie Infrastructure Corporation in two 10b5 cases arising from its the announcement of¬†its 2017 financial results and dividend guidance for 2018.
