Deborah is a Principal Associate in our Commercial Dispute Resolution team. She has experience of resolving a range of high-value and strategically important commercial disputes for national and international clients across a number of industries, including breach of contract claims, tort claims, product contamination claims and public procurement disputes. She has significant experience of Court proceedings and obtaining urgent injunctive relief, but is also able to assist clients to resolve their disputes without recourse to the Courts, through negotiation and mediation.

Deborah also has experience of advising business on their potential liabilities under product liability legislation, guiding them through trade withdrawals or product recalls, and acting in subsequent compensation claims following the supply of defective products. She frequently delivers public training on preparing for and handling product recalls.

Whilst her practice is not limited to this area, Deborah has worked for a number of clients in the food and drink sector and is aware of the unique issues companies in this sector face.

Deborah is named as an associate to watch in Chambers 2014 which notes that she is "a highly rated associate tipped for a big future ".

Gary Pellow and Richard Matthews lead Eversheds Sutherland (International) LLP’s ‘organised, friendly and approachable’ practice, which also fields TMT dispute specialist James Hyde, energy litigator Mark Howarth, principal associate Deborah Polden, who ‘works to get the best results for clients’; and senior associate Ed Williams, who specialises in IT disputes and public procurement challenges. Recent highlights for Hyde include representing the Canal & River Trust in the Court of Appeal in a case regarding the price to be paid by Thames Water for water abstracted from a waterway owned by the trust. The practice also acted for an automotive part manufacturer in claim in the High Court arising from a fatality on a French motorway, and defended a Middle Eastern oil company in an arbitration relating to the sale of gas under a long-term gas sales agreement. Other mandates include acting for Theakston Estates in a limited liability partnership dispute and representing a Middle Eastern state in an arbitration regarding contracted trade. Vodafone, Specsavers, DHL and EDF are also clients.

  • THE VAT E-COMMERCE PACKAGE

    A. INTRODUCTION   The VAT E-commerce Package adopted by the Council on the 5th of December 2017 includes several changes that will be gradually implemented, some changes will be effective as from the 1st of January 2019 and the rest as from the 1st of January 2021.
  • Doing business in Ukraine: turning point for the currency control in Ukraine

    One of the most hotly discussed topics in 2019 is currency control liberalization in Ukraine.The currency control liberalization was one of Ukraine’s priorities under the EU-Ukraine Association Agreement. At the beginning of 2019 the National Bank of Ukraine (hereinafter the “NBU”) approved and promulgated all long-awaited regulations, serving as the basis for a new liberal system of foreign currency control. The new currency control system will be launched on 7 February 2019, the same day as the Law of Ukraine  On Currency and Exchange Transactions  becomes applicable. The changes are aimed at deregulation, facilitating cross-border transactions with foreign currency and expanding the list of available foreign currency transactions.
  • New Long Term Residency Visas

    After much media coverage, Cabinet Decision 56 of 2018 (the Decision ) has been gazetted which introduces new long term residency visas to, amongst others, four categories of persons in the UAE. 
  • Significant Changes to Civil Procedure Code

    Significant changes to Federal Law No 11 of 1992 (the Civil Procedure Code ) will soon be coming into effect. These changes are introduced through regulations (the Regulations ) issued under the Civil Procedure Code and will come into effect on 16 February 2019.
  • Merger Clearance Matters

    The United Arab Emirates (the UAE ) promulgated legislation to specifically address the regulation of competition (being Federal Law 4 of 2012, or the Competition Law ) several years ago but until recently, it has been the case that the requisite implementing regulations and processes were not in place. This is no longer the case. Not only have the much anticipated implementing regulations been issued, the UAE Ministry of Economy (the Ministry ) (being the regulator in charge of administering the UAE competition regime) has now formed the required committee and issued the anticipated guidance and forms to allow concerned parties to make merger clearance submissions to the Ministry where required to do so pursuant to the Competition Law.
