Thomas is an Associate in Eversheds’ Construction & Engineering team, specialising in both non-contentious and contentious construction matters.
Construction Procurement:
Thomas regularly advises developers, funders and occupiers on development schemes throughout the UK in sectors such as retail, food and drink, property, education, health, finance and infrastructure.
Examples of Thomas' non-contentious experience includes:
- drafting, negotiating and managing the delivery of building contracts, letters of intent, parent company guarantees, performance bonds, professional team appointments, framework agreements, collateral warranties, third party rights and reliance letters;
- advising on a range of standard form contracts including JCT and NEC, along with drafting bespoke terms and conditions; and
- drafting and negotiation of the construction-related elements of funding agreements, development agreements and agreements for lease and advising upon the discharge of client's obligations pursuant to third party agreements.
Contentious Experience:
Thomas also has experience providing pre-dispute strategic advice and assisting on fast track and multi track disputes in the Technology and Construction Court along with alternative dispute resolution methods such as mediation, negotiation, and adjudication.
Thomas' recent contentious experience includes:
- advising a leading international property developer on the application of liquated damages under an amended JCT contract;
- advising a major telecommunications provider on a multimillion pound adjudication relating to a breach of contract claim (as defendant); and
- advising a leading housing trust on a mediation in respect of a professional negligence claim (as claimant).
Thomas studied Law at The University of Leicester before joining Eversheds as a Trainee Solicitor in August 2010. In addition to Construction, he has also spent time working within the Financial Services Dispute Resolution, Restructuring, Insolvency and Planning teams.
