Position

Kelly L. Hensley is a partner in the Labor and Employment Practice Group in the firm's Los Angeles office. She is Co-Practice Group Leader of the Labor Practice Group. Ms. Hensley specializes in labor and employment counseling and wage and hour matters.

Career

Ms. Hensley regularly conducts wage-hour and HR-related compliance audits for companies of all sizes. Ms. Hensley helps clients create compliance programs designed to meet state and federal requirements. Ms. Hensley regularly counsels employers in all aspects of California and federal employment law, including employee hiring and discipline procedures, unfair competition matters, worker classification issues, leaves of absence, wage and hour law, and employee severance and termination strategies. Ms. Hensley has substantial expertise drafting all types of employment agreements and policies, including employee handbooks, independent contractor agreements, confidentiality and non-disclosure agreements, sexual harassment policies, email and internet usage policies, and employment-related forms. Ms. Hensley advocates a proactive approach, counseling employers to evaluate their employment practices to minimize liability exposure. Her client-focused counsel is tailored to serve the long term goals of each client. Ms. Hensley frequently conducts training lectures and seminars on general human resources issues. She also assists with sexual harassment and other employment related investigations, and implements effective employee discipline or exit strategies in response to those investigations. In addition to her counseling practice, Ms. Hensley regularly represents clients in wage-hour class actions and matters before administrative agencies.

Sheppard, Mullin, Richter & Hampton LLP handles the full range of labor and employment disputes, from single plaintiff cases to class actions. The team is jointly led by Kelly Hensley, Greg Labate and Jonathan Stoler, who are based in Los Angeles, Orange County and New York respectively. Palo Alto's Paul Cowie successfully represented Swift Transportation in a wage-and-hour rest break putative class action, as well as Granite Rock in a wage-and-hour case, which had multiple millions of dollars at risk. The Century City-based Thomas Kaufman was able to obtain a victory for Cox Communication when a judge granted a class-wide summary judgment on the claim for failure to pay field technicians for certain time spent driving in company vehicles. Derek Havel, Daniel McQueen as well as Tracey Kennedy and Richard Simmons in Los Angeles are noted. In March 2018, Denise Giraudo became a part of the team in Washington DC, joining from Ogletree Deakins, and, shortly after, Stephen Fox joined in Dallas from Polsinelli PC. Travis Anderson and Justine Phillips in San Diego and Robert Mussig in Los Angeles made partner.
