Banking and finance Tier 1
Guevara & Gutiérrez S.C's practice handles the full range of finance work, from loan agreements and securities, to credit facilities, capital markets matters and regulatory mandates. Project finance specialist Jorge Inchauste (particularly noted for his structured finance expertise) and Ramiro Guevara (a former head of the legal department at the Bolivian Central Bank and director of the National Stock Exchange) are the key names in the La Paz office. Firm founding partner Ramiro Guevara and M&A-heavyweight Jorge Inchauste co-lead Guevara & Gutiérrez S.C’s 18-strong corporate practice group, which handles the full gamut of corporate matters, including M&A and associated due diligence, incorporations, joint venture contracts, international public and private tenders, restructuring and insolvencies. Moreover, in addition to successfully growing its domestic client roster, the firm has also added a number of key Asian clients recently, notably Kunming Liheng Investment and the Korean Resources Corporation (which includes LS Nikko, LG International Corp, Posco Daewoo Corp). Recent headline matters saw Inchauste lead advice to Alicorp on the $238.7m restructuring of its Bolivian subsidiaries via merger into a single entity. Complex litigation and arbitration specialist Rodrigo Rivera, in La Paz, and Santa Cruz-based Primitivo Gutiérrez (labour disputes), co-lead Guevara & Gutiérrez S.C’s disputes practice, which has solid expertise in handling administrative, antitrust and constitutional litigation, notably for construction and industrial clients. A case in point is Cervecería Boliviana Nacional, which the team continues to defend in multiple Supreme Court competition proceedings. Arbitration is another core strength of the group: Ramiro Guevara is highly regarded for international commercial and investment arbitration; while Enrique Barrios, who has ICC, ICSID and IACAC experience, is noted for his expertise in negotiations, including between investor and state. Focused on complex matters, particularly related to major projects and structuring, the tax practice at Guevara & Gutiérrez S.C supported by the firm's broader service offering - particularly the administrative and corporate teams - seeks to offer a one-stop-shop service. The Bolivian member of the Latin American Tax & Legal Network (LATAXNET), it's mandates range from early-day advice on projects prior to their structuring, tax optimisation and general tax matters, to tax litigation - a key strength - in both administrative and judicial instances. The practice is also prominent on the tax aspects of major corporate and energy-sector instructions. Practice head Mauricio Dalman focuses on international planning, corporate and tax advice and the development of optimum tax structures for businesses operating in Bolivia. Dalman is also deeply experienced tax litigator before the administrative, judicial and constitutional courts, and can also call on contentious partner Rodrigo Rivera, who also has tax disputes experience.
