Career
Oscar Vela Descalzo has been a partner of the firm since 1996 and manages the Negotiation, Dispute Resolution and Litigation area. With more than 30 years of experience, he has led different cases with great success for our clients.
He advises national and international clients in civil, commercial, labor and intellectual property enforcement matters, both in the judicial and administrative spheres or using alternative dispute resolution methods, such as negotiation, mediation and arbitration.
Oscar also advises several companies that breed rose varieties, a key driver of this productive sector in the country. For more than 25 years, he has been constantly working with these companies in the regularization of illegal producers and the defense of Intellectual Property rights.
In addition, his trajectory includes relevant successful cases such as: judicial process and mediation for the resolution of conflicts arising between the heirs of the master Oswaldo Guayasamín; constitutional actions against mining concessions and companies; trial won on behalf of Bartow, Lide and Gilbert, for tort liability against a reputable securities transportation company. Legal, judicial and administrative actions before the National Service of Intellectual Rights and administrative instances in favor of, among others, Warner Bros. Disney and Microsoft.
National and international arbitration on behalf of mining and energy companies; foreign public companies against the Ecuadorian State; foreign private companies.
Since 2019, Oscar is part of the team of lawyers advising Nelson Serrano Saenz, Ecuadorian unjustly imprisoned in the USA, with the objective of obtaining his freedom.
Additionally, Oscar is an arbitrator of the Cámara de Comercio de Quito since 1999.

Tobar ZVS houses an intellectual property and anti-piracy team capable of protecting patent, trade mark and copyright portfolios, with particular experience handling enforcement campaigns and border measures relating to the Andean community. Led by Oscar Vela, Tobar ZVS‘ dispute resolution unit utilises mediation to resolve most of its clients’ disputes. Sector strengths for the group include mining, insurance, food and drink, plant breeding and construction, among others. A key addition to the group in 2022 was Marielena Zary, who is particularly known for her work in insurance disputes and supports René De Sola, who is also extremely active in insurance cases.
