Joined the Bustamante & Bustamante Law firm in the year 1984. Partner since 1990. Started work in the civil litigation department of the Firm, handling multiple lawsuits concerning a plane accident in the 1980s. For approximately five years was professor of family law at the Pontifical Catholic University of Ecuador. Was also a professor at Universidad Internacional del Ecuador, teaching corporate law and securities law.

Practice in labour law covers labour and collective bargaining lawsuits and restructuring the personnel system. Provides legal assistance regarding the labour law in force and its application. Has provided legal advice in public procurement and environmental matters with different decentralized governments concerning the construction of hydroelectric dams, photovoltaic projects, grey water management, river cleaning and waste recycling plants. Since 1995, has practised in the areas of insurance and securities market. Was a member of the National Securities Council from 2000 to 2009. Participated in different matters as alternate councilmember for ten years, making her an expert in the field of securities and insurance. Bustamante & Bustamante has considerable experience in the employment law sphere as well as in immigration matters. Patricia Ponce is a widely recognised expert in the field; she recently assisted Michelin with restructuring its labour benefits arrangements to bring them in line with the company's Colombian ones. Other work includes advising Subway on the hiring process for a new commerce agent, which included advice on the labour contract and the acquisition of the agent's visa, among other work. José Rafael Bustamante Crespo, who jointly leads the team with Ponce, represents Franks International in two occupational disease litigation cases; the employee claimants are pursuing damages for workplace diseases alleging arising from work in  the oil fields.     On 2 October 2019, the Court of Justice delivered its judgment in Bajratari v Secretary of State for the Home Department (Directive 2004/38/EC) Case C-93/18 which concerns Chen applications and the source of funds for self-sufficiency. 
  • End of the ‘centre of life test’ in Surinder Singh cases?

    In the recent case of  ZA (Reg 9. EEA Regs; abuse of rights) Afghanistan   [2019] UKUT 281 (IAC ), the Upper Tribunal found that there is no basis in EU law for the centre of life test, as set out in Regulation 9(3)(a) of the Immigration (European Economic Area) Regulations 2016 (the “Regulations”). It further found that it is not to be applied when Judges assess  Surinder Singh  cases that appear before them.
