Position

Katie McCarthy is a partner in the Intellectual Property Practice Group in King & Spalding’s New York office.

Career

Ms. McCarthy has twenty years of experience in litigation and related counseling in domestic and international trademark, copyright, false advertising, right of publicity, unfair competition and internet matters. Ms. McCarthy has first-chaired two of three full trials and numerous preliminary injunction hearings and has practiced in the federal courts, the U.S. Patent and Trademark Office, including the Trademark Trial and Appeal Board, the International Trade Commission, and ICANN domain name arbitrations. In addition to litigation, Ms. McCarthy also directs international and domestic trademark clearance and prosecution programs.

New York-based Kathleen McCarthy recently represented Google in a case brought by Baldino’s Lock & Ke, which claimed that the appearance of unlicensed locksmiths on the client’s various platforms have harmed its business. In Houston, Bruce Baber is notably acting for The Coca-Cola Company in its efforts to register its ‘ZERO’ trademarks; the matter is currently being considered by the Federal Circuit. In another highlight, both McCarthy and Baber acted for Chevron in two separate pieces of trademark infringement litigation in which the defendant used the client’s name and marks without permission.
