Financial Markets and Funds

David Brennand is adept at creating structures for collective investment across a variety of asset classes. He frequently advises on the structuring and operation of investment funds and other collective investment structures.

Designing investment structures requires creativity and foresight. David brings those skills to his work advising on the creation, operation and restructuring of funds and other collective investment arrangements. In tandem to this, he also negotiates agreements that govern managed accounts, seed capital arrangements and illiquid portfolio acquisitions and divestments.

David has worked with clients on mandates that traverse the spectrum of complexities applicable to collective investment structures in both a trading and investing context, but is particularly experienced in structuring bespoke arrangements to satisfy the specific requirements of investment managers and investors alike. For one client, he helped structure a number of complex joint venture arrangements together with complementary fund structures that complied with the laws of multiple jurisdictions and were also Shari’a law compliant. These structures permitted the client and its joint venture partner together to acquire and manage (on a rolling basis) a series of commercial real estate portfolios in Europe, as well as allowing the client to syndicate its investment in these portfolios to its underlying clients via the associated fund.

David’s experience in collective investment structuring is also germane when he represents institutional investors with respect to proposed investments by them in collective investment structures at the outset, the acquisition and disposal of investments by them in alternative investments on the secondary market and when they are proposing to enter or exit from co-investment arrangements with collective investment structures.
