Mark Botti is an experienced antitrust litigator, having litigated and tried cases involving some of the most complex antitrust issues, including complex merger challenges and monopolization cases in both private practice and during his government service. He has been extensively involved in litigated antitrust cases in many industries—some highly regulated and some old economy—including healthcare, health insurance, dental care, dental insurance, medical and dental products, national defense contractors, music licensing, consumer and institutional dairy products, industrial paper manufacturing, plumbing products, electronic fund processing of government welfare benefits, auto dealership financing, auto insurance, cement, consumer noodles, property and casualty insurance, and computer chips.
Prior to his government service, Mark was a partner in a private law firm where he litigated and tried a number of antitrust, as well as non-antitrust complex civil cases. Mark served for 13 years at the U.S. Department of Justice in various litigation and leadership positions within the Antitrust Division. In addition to directly litigating and trying a number of cases while at the Division, he prepared numerous preliminary injunction merger cases and actively supervised a number of civil actions. Upon re-entering private practice, his litigation experience has remained focused almost exclusively on antitrust matters. Throughout his career, he has spoken and written authoritatively on merger litigation and antitrust litigation generally.
