Position

Gary McLaughlin represents employers in employment and related matters in state and federal courts and before administrative agencies. His practice includes extensive experience with wage and hour class action and other representative litigation, including California Private Attorneys General Act (“PAGA”) actions, as well as discrimination, harassment, retaliation and wrongful termination claims. Mr. McLaughlin also counsels employers on labor and employment issues, such as wage and hour compliance, terminations, investigations, family and medical leaves, employee handbooks, independent contractor classification, and contracts, and he frequently advises employers on California non-competes and restrictive covenants. He has represented clients in a variety of industries including retail, food services, insurance, financial services, healthcare and entertainment.

Practice head Robert Lian has more than 25 years of litigation experience. The recommended Daniel Nash defended Ernst & Young in a highly publicized dispute in which the Supreme Court ultimately ruled that an arbitration agreement entered into by the plaintiff was enforceable, thereby dismissing a putative wage-and-hour class action. In another work highlight, Nash and Stacy Eisenstein were engaged by the NFL after a running back appealed his suspension under the league’s personal conduct policy.
