Position

In March 2016 Kathleen joined as a partner to head up our London patent team.

She has a BSc in Maths & Physics from Durham University and has a wealth of experience in patent litigation and patent strategy advice in a variety of industry sectors, substantially in in the telecoms, electronics, IT pharmaceuticals, biotechnology, chemicals, and banking industries. This includes multi-jurisdictional litigation co-ordination, interim injunctions, infringement and validity litigation in the High Court, Court of Appeal, and Supreme Court, and oppositions before the European Patent Office, as well as patent portfolio strategy advice. 

In relation to telecoms/ IT/electronics, her work has concerned patents for various aspects of mobile phones, including speech coding and advice relating to standard essential patents and FRAND as well as encrypted email, bank card security, optics an semi-conductors. 

She advises pharmaceutical and biotech companies, in relation to large and small molecule drugs, in relation to pre-litigation strategy, opinions as to infringement and validity, and patent litigation including SPC aspects, as well as regulatory issues affecting pharmaceutical companies. 

Kathleen has significant experience advising in relation to competition law aspects associated with patents affecting the pharmaceutical and telecoms industries. She also advises start-up companies on all IP aspects affecting company set-up and investment. 

Her UK experience and success is second to none in a number of areas, particularly interim injunctions in UK patent disputes, calculation and recovery of damages due to interim injunctions, and costs recovery. Her particular strengths are in careful strategy, good judgment, seeing the-wood-for-the-trees, and the management of teams in a calm, unflappable manner. 

She is currently acting for Ericsson as co-counsel with Freshfields in the epic series of telecoms and FRAND actions in Unwired Planet v Samsung, Google & Huawei, in relation to confidentiality aspects and patents aspects arising in the competition law trial, arising from Ericsson’s sale of patents to Unwired Planet.
