Andy is an experienced criminal regulatory advocate who advises both public and private sector clients including local authorities, fire authorities and health trusts as well as acting for private commercial organisations directly or through their insurers. 

Andy is able to call upon his eight years’ experience as a criminal lawyer when dealing with investigations and prosecutions.  He specialises in regulatory work defending corporate bodies and individuals in prosecutions brought by Regulators such as the Health and Safety Executive, Environment Agency and local authorities. He also prosecutes cases advising and representing organisations such as Natural England, the Marine Management Organisation and Fire Authorities.  He has a considerable knowledge of the law relating to corporate manslaughter having represented a client before the Parliamentary Committee charged with the duty of scrutinising the proposed legislation and has acted for clients both before and after the new law came into force. He has advised in respect of numerous fatal and non-fatal accidents and criminal investigations in connection with a variety of industries and undertakings. This includes deaths or serious incidents on construction sites, industrial premises, farms and in NHS and local authority premises.  His thorough preparation of cases allows informed decisions to be taken about interviews under caution and prepares the bedrock for effective and robust management of any investigation or prosecution to ensure the most effective outcome for the client. Andy also provides pro-active risk management advice to organisations in respect of the issues surrounding corporate manslaughter and other specific health & safety risks and has spoken to Boards of both public and private sector organisations on these topics. He has assisted corporate bodies and individuals in connection with health and safety risks including asbestos and asbestos management, legionella, work at height, confined spaces and the CDM regulations. 

He appeared before the Work and Pensions Parliamentary Committee on behalf of the Association of Principal Fire Officers during the consultation phase of the Corporate Manslaughter Bill.

Practice head Andrew Hopkin recently advised the Derbyshire Fire & Rescue Authority on the successful investigation and prosecution of a local freeholder for fire safety offences. ‘Superb’ associate barrister Carl May-Smith is also recommended.
