Position

Simon heads up the firm's health practice nationally, and is responsible for the sector strategy across all of Browne Jacobson’s Offices.

His practice is primarily contentious, advising on regulatory matters, inquests, and clinical governance matters.

He is client partner for a number of our key clients including the Medical Protection Society, Derby Teaching Hospitals NHS Foundation Trust, Nottingham University Hospitals NHS Trust

Notable cases this year include: 

  • Advising Derby Teaching Hospitals NHS Foundation Trust in respect of one of the First “Fit and Proper Person” challenges by CQC, in respect of a complaint against the Chief Executive of the Trust. Simon led a multi-disciplinary team advising on the regulatory aspects of the case, as well as advising on publicity issues.
  • Acting for Nottingham University Hospital NHS FT at an inquest over the course of two weeks, into the death of a lady who suffered a massive bleed during spinal surgery. He has also spoken on consent to the claims team at Medical Protection Society and various NHS Trusts.
  • Simon has also spoken widely on consent to treatment issues. This includes speaking at the National Brit Spine Conference in April 2016, as one of the Keynote Lecturers on informed consent (other speakers were a spinal surgeon and Gerard Martin QC

Simon has a particular interest in the provision of training to health sector professionals, and regularly provides training sessions on a wide variety of topics.

He is a key note speaker on the mock inquest training product Browne Jacobson has developed with Derby Hospitals NHS Trust, and which has been attended by over 1,500 delegates in the last five years.

Browne Jacobson LLP primarily advises clients from the public sector such as NHS trusts, but increasingly undertakes work for independent health providers. In addition to its impressive track record in the health sector, the team also handles social care mandates. Practice head Simon Tait recently handled a substantial number of governance-related matters, including in relation to mergers or sustainability and transformation partnerships. Oliver Pritchard advised the Derby Teaching Hospitals NHS Foundation Trust on its proposed £650m merger with Burton Hospitals NHS Foundation Trust, including full pre-merger due diligence, and governance structure and employment advice, while Tait represented the client in an investigation and subsequent inquest into the death of a two-year-old from meningitis.
