Prior to joining Collas Crill, Daian was admitted to practice as a barrister of the Eastern Caribbean Supreme Court and worked for two law firms in the British Virgin Islands. Before relocating to the BVI in 2016, she was a barrister at a leading set of Chambers in England where she had a strong commercial and chancery practice and acted as a mediator in a number of civil and commercial disputes.
Daian has considerable experience of corporate and commercial litigation including domestic and cross-border insolvency, shareholder disputes, trust litigation, asset tracing, enforcing foreign arbitration awards and judgments, and seeking injunctive relief including on an emergency basis. She has appeared in the BVI Commercial Court and High Court, and at various levels in the courts of England and Wales.
Prior to qualifying as a barrister she was a university lecturer and taught law at undergraduate and postgraduate level in a number of higher education institutions, including the Hong Kong University’s School of Professional and Continuing Education.
Collas Crill‘s ‘exceptionally good‘ disputes practice covers a varied range of mandates in both the offshore space as well as issues arising on island. Practice head Damian James is active in both high-stakes trusts and commercial disputes. Simon Hurry, on top of further trust litigation work, is able to draw on his experience in the Cayman Islands in handling asset tracing and insolvency matters; he is involved in the Crociani saga for Grant Thornton while of counsel Sam Williams heads a team representing Appleby Trust Mauritius. Nuno Santos-Costa, the firm’s senior partner in Jersey, handles varied litigation including prosecuting criminal cases as a Crown Advocate and representing high-net-worth individuals in construction disputes, and in a similar vein Dionne Gilbert handles a mixture of work including commercial matters, landlord and tenant cases and contentious probate. Dan Boxall is another key of counsel, and among the senior associates Daian Sumner joined in October 2019 from AMS Law in the BVI and clients also praise Lynne Calder.
