Career

Josephine acts for a wide range of professional trustees, settlors and beneficiaries, including leading trust companies, private banks and fimily offices on all issues concerning trusts and foundations as well as private wealth, probate and regulatory matters. Her principle areas of expertise include advising ultra high net worth clients and family offices on the establishment and administration of complex trust structures, advising on and drafting the documentation to restructure trusts and advising on rectifying and mitigating breaches of trust. Josephine also advises on charitable and philanthropic structures.

Josephine works closely with her Dispute Resolution colleagues in connection with trustee representations to court and her Investment Fund colleagues in relation to Jersey’s private fund regime.

Josephine has been recognised in Chambers HNW, Chambers UK, Legal 500 UK, Legal Week Private Client Global Elite and by Citywealth as a Future Leader.

Clients say that Josephine “has a huge amount of Jersey trust experience and is able to provide first-rate trust advice (technical, trustee advisory, and associated areas) in a very short timescale” and a “go-to name for establishing family offices”.

Josephine is an Advocate of the Royal Court of Jersey, a BVI Solicitor and a Scottish Solicitor; a member of The Society of Trust and Estate Practitioners (STEP); and a member of the Jersey Finance working party on Family Offices in Jersey.

Josephine contributes to various publications including Trust & Trustees, STEP Journal, Offshore Investment, Jersey Finance and e-private client and regularly presents to local trust companies. She is peer reviewer for ‘Trust & Trustees: Foundations special edition’; co-author of the Jersey chapter of ‘European Cross Border Estate Planning’; co-author of the Jersey chapter of ‘Planning & Administration of Offshore & Onshore Trusts’; and a contributor to the Jersey chapter of International Succession Laws. Josephine has also spent time on secondment as in-house legal counsel to a local trust company.

Josephine contributes to articles for various publications including Trust & Trustees, Offshore Investment, Jersey – First for Finance and e-private client and regularly presents to local trust companies and has spoken at the International Trusts Congress in London.

Education

Josephine received her LLB, with Honours, from the University of Glasgow and her Diploma in Legal Practice from the Glasgow Graduate School of Law. She was admitted as a Solicitor and as a Notary Public in Scotland after training with Bishops LLP (now Brodies LLP) in Glasgow and was admitted as an Advocate of the Royal Court of Jersey in January 2009.

Ogier‘s private wealth team works alongside the firm’s corporate, funds and private equity practices to support HNW families seeking to set up trusts in Jersey, advising on the establishment and management of complex trust structures and private investment funds, with an increased focus on ESG investments. Beyond trusts, the practice has assisted with setting up Jersey-registered charities and other philanthropic vehicles, as well as building up its ties to clients in the Middle and Far East. James Campbell and Josephine Howe jointly lead the practice, advising professional trustees and family offices on all aspects of Jersey trusts, with the latter also providing support in regard to charitable structures. Katherine Neal is the group’s employee incentives specialist, advising on employee reward schemes, pension plans and JPUTs, while Henry Wickham handles matters relating to estate planning and issues concerning wills. Steve Meiklejohn is noted for his work advising HNWIs on estate planning, trust and fiduciary structures.
