Commercial dispute resolution. Types of work include general contract disputes, professional negligence, breach of warranty claims, shareholder disputes, partnership disputes, fraud related claims. Particular expertise in the housebuilding sector having acted over the years for most of the top ten largest housebuilders in the UK on a broad range of disputes within that sector with vendors/purchasers of land, joint venture partners, suppliers, contractors, professional advisers, land agents and customers. SES Contracting Limited v UK Coal Mining Limited & Others [2007] EWCA Civ 791 – acting for appellants in successful appeal before the Court of Appeal in respect of an application for pre-action disclosure in respect of fraud related allegations – reported case; CPH Holdings Limited v Persimmon Homes Limited (2008) – acting for defendant in successful defence of £2.7m claim for payments due under an alleged joint venture agreement Crest Nicholson (Eastern) Limited v Western [2008] EWHC 1325 (TCC) – reported case; Persimmon Homes Limited v Great Lakes Reinsurance [2010] EWHC 1705 (Comm) – claim against ATE Insurer for an indemnity in respect of an avoided ATE insurance policy – reported Case; Heaselands SA v Crest Nicholson (South) Limited & Others – acting for defendant in £11.7m claim relating to payments allegedly due in respect of land in Haywards Heath. Case settled in June 2014 after four days of a 15 day trial.

Gateley Plc‘s ‘absolutely excellent’ group has substantial expertise across the housebuilding, retail, energy, education and procurement sectors; recent mandates include defending Persimmon in a group action brought by 69 residents who allege that that sea-facing windows in a new apartment block on Swansea Dock have experienced water ingress, acting for Repsol Sinopec Resources in a contract dispute with One Sub Sea regarding equipment, and acting for the University of Leicester and St George’s, University of London in judicial review proceedings against students.
