Position

Richard has over 16 years’ experience of specialising in contentious insolvency, with particular emphasis on recovering the proceeds of fraud. Richard has acquired wide-ranging experience of recovering the proceeds of tax evasion. He has conducted several reported cases, including successful cases in the Court of Appeal in the UK, Hong Kong and Singapore. He was also instrumental in negotiating a tripartite agreement between the Dutch Prosecution Service, HMRC and the prosecuting authorities of the Netherland Antilles, which was subsequently approved by the Court of the Netherlands Antilles, securing the release of in excess of tens of millions of pounds with further sums, and securing many tens of millions. Richard has substantial experience in all aspects of contentious insolvency, with particular emphasis on acting for insolvency practitioners, in particular those who specialise in contentious insolvency. Richard’s clients include: Grant Thornton; Baker Tilly; KPMG; Ernst & Young; Griffins, FRP Advisory; and Kingston Smith & Partners, in addition to institutional clients. In addition to his work with the private sector, Richard has very considerable experience of acting for the Crown, both the Insolvency Service and HMRC. He has regularly been instructed to advise clients on the investigation and evidence-gathering stage which is an essential forerunner to subsequent litigation brought by office-holders. In particular, Richard has been instructed to pursue claims under the Insolvency Act and common law to recover the proceeds of fraud, although he also regularly conducts complex claims for wrongful trading, preferences, transactions at an undervalue, transactions defrauding creditors, unlawful means conspiracy, dishonest assistance and knowing receipt, as well as other breach of duty claims.
