Position

Heads the commercial dispute resolution and restructuring and insolvency teams. Extensive experience of complex commercial contract disputes, Commercial Court and TCC work, insolvency matters, partnership disputes, property disputes and ADR. Fully trained mediator. Acts for clients ranging from PLCs to SMEs as well as many insolvency practitioners and insurers. Specialises in complex commercial, property, and trust disputes and all types of insolvency matters. Robert is engaged in helping clients to pursue recoveries and to take preventative and defensive steps arising out of employee breach of restrictive covenants and third party dishonesty as well as dealing with the prevention of defamatory content in national newspapers and other media. Has advised on IT issues including compelling the release of significant data being held back by a third party IT provider in a contractual dispute. Has acted for clients in several mediations. Advises insurer clients in relation to claims brought against licensed conveyancers and other professionals. His experience includes obtaining injunctions to avoid dissipation of assets, advice on varied property litigation matters. In relation to insolvency matters has experience in dealing with both corporate insolvency actions and all aspects of personal insolvency. Has acted on RoT claims, undervalue and preference claims and all other manner of corporate disputes.

Weightmans LLP’s commercial litigation practice handles a range of contentious cases involving IP, defamation, property damage, civil fraud and reputational issues, with the public and financial services sectors key areas of focus. It represented Business Energy Solutions and BES Commercial Electricity in a £10m High Court case involving reputation management issues and represented Cardoman 116 in a £2.4m breach of warranty dispute arising from a share sale purchase agreement. It also represented Joseph Gleave & Son in the latest challenge, in a series of claims, against the Ministry of Defence seeking to set aside its procurement processes. Thomas Cook Airlines, Abbey Life Assurance Company and Capita Property and Infrastructure are also clients. Among the team, Robert Jones handles commercial contract disputes, professional negligence, shareholder, trust and probate disputes and ADR and is 'capable of identifying, at an early stage, the most realistically achievable outcome'. Regional office head Richard Corran is ‘very able’. The ‘brilliantCarole Spiller is noted for her experience in professional negligence cases and has a 'good grasp of the detail and technical elements of the law but as the same time brings a focussed commercial approach to the issues at hand'.   Damian Carter is experienced in high-value corporate disputes.
