Intellectual Property Litigation and Enforcement

Jason Chan is a founding Director of Amica Law LLC, and heads the firm's Litigation and Enforcement practice. He has been practising since 1992, specialising in intellectual property (IP) disputes and enforcement. He is also a Registered Patent Agent and is certified under the Federation Internationale des Conseils en Propriete Industrielle (FICPI) South East Asia Patent Drafting program.

Jason has litigated numerous cases, and has acted for clients in patent infringement actions involving the HIV-2 virus, synthetic diamond manufacture, oil drilling platforms and exhaust systems and portable USB flash devices; copyright proceedings involving pirated movie site blocking orders; passing off actions involving the use of a brand for a worldwide chain of hotel properties; and IT contract claims involving design, delivery, and installation of IT systems for a pension statutory body.

Over and above litigating, he also advises clients on telecommunications laws and agreements, IT, software, database rights and privacy, and Internet and domain name disputes. His clientele includes local telecommunication companies, for which he has advised on matters relating to network infrastructural rollouts, licensing regimes, interconnection & interoperability, pricing, anti-competition rules and data protection; and major American consumer products companies, for which he has managed their country IP enforcement programmes. He has also advised clients on interactive online and mobile gaming services.

Jason has been listed as a leading lawyer in Singapore in many regional and international publications, such as Legal 500 (2011 - 2017), Lawyer Monthly Magazine, World IP Review Leader Singapore (2016 - 2017) and the World Trade Mark Review (2018). He has also been cited in the Legal Media Guide to the World’s Leading Patent Law Practitioners, World IP Contacts by Managing IP, Who’s Who Legal Singapore Patents, AsiaLaw Leading Lawyers and Asia IP Experts. Chambers Asia Euromoney Guide to the World's Leading Trademark Law Practitioners described him as being "an immensely commercially-minded litigation lawyer whose clear, logical analysis is of exceptional value", whilst the Managing IP Handbook states that he has been "praised by both peers and clients as one of the best lawyers around".

His wealth of experience renders him an invaluable member to various IP organisations. He is the Co-Chairperson of the Anti-Counterfeiting Committee of the Asian Patent Attorneys Association (APAA), which spearheads the review of latest developments in the law in the Asian region, the conduct of studies on selected issues and the submission of proposals for improvement in the law and practice. He was formerly the Co-Chairperson of the Copyright Committee of the APAA as well for 6 years. He is also an Exco Member of the APAA (Singapore Group), helping to promote and enhance IP protection in the Asian region.

Jason has also made significant contributions to the existing literature and to the advancement of IP law in Singapore. He stands as a Contributing Author for the "Law and Practice of Commercial Litigation in Singapore" (Sweet & Maxwell, 2015) and sits on the Law Ministry's Committee to Review Singapore's IP Dispute Resolution Framework. He also invests his time and energy in raising up the next generation of lawyers, serving as an Adjunct Tutor for both the Practice Law Course conducted by the Singapore Institute of Legal Education (SILE) and the Graduate Certificate in IP Law course conducted by the Law Faculty of the National University of Singapore (NUS).

Specialist Amica Law LLC is recommended for the breath of its IP expertise, serving both international and local clients that include ExxonMobil, Huawei Technologies and the National University of Singapore. The team is acting for M1, the telecoms service provider in an application brought in the High Court by Disney Enterprises, 20th Century Fox and others for a Copyright Blocking Order. The case concerns a novel point in Singapore concerning whether the order remains binding if pirate websites change their IP address. It is also acting for Sun Pharmaceutical Industries, which applied for a product licence in Singapore to distribute a generic pharmaceutical product. This was blocked by Millennium Pharmaceutical under the patent declaration regime of the Health Products Act and the team is now acting for Sun in defence of a patent infringement action.
