Commercial Insurance

Partner – Insurance, focusing on Professional Indemnity, D&O, Class Actions and Regulatory Investigations.

Malcolm is a highly skilled lawyer with particular expertise in class actions, supplemented by specialist expertise in insurance, including providing coverage advice to insurers as well as acting to defend their insureds. He has an outstanding track record of achieving positive outcomes for clients by resolving their disputes in a timely and cost-effective manner without litigation where possible, and by litigating to successful conclusion where necessary. His clients expect and receive proactive and early advice which focuses on setting a clear resolution strategy. His ability to get to the heart of a matter—regardless of complexity—quickly and efficiently, is one of his key strengths.

Malcolm advises company directors and other professional people on professional indemnity and directors’ insurance issues. He represents them when they are being investigated by a regulator and/or being sued. He also helps them deal with disputes, which are less formal, such as unlitigated claims and disputes before AFCA.

Malcolm was featured in 2020 by Chambers as a ‘Recognised Practitioner’. He has been acknowledged as a Pre-eminent (2019),  Leading (2020) and Recommended (2021) Professional Indemnity lawyer in the Doyle’s Guide (and as a leading lawyer in the area since 2014). Malcom has most recently been included in the Best Lawyers in 2022 for Class Action Litigation, Insurance Law and Professional Malpractice Litigation.

Malcolm was appointed as National Practice Head of the Commercial Insurance group in 2021 and is currently a member of the Sparke Helmore Conflicts Committee.  Malcolm was formerly a member of the Sparke Helmore Board.

Malcolm was admitted in 1994 and commenced his career at Corrs where he worked as Lawyer and Senior Associate until 2004, interrupted only by a brief stint at Nash O’Neill Tomko during 1999 and 2000. Malcolm commenced at Sparke Helmore in 2004 and was made a Partner in 2007.

Malcolm is a member of the Law Society of New South Wales.

Malcolm has a Bachelor of Arts and Bachelor of Laws degree from the University of Sydney.
