Position

Partner in the Commercial Litigation and Securities Litigation departments.  Sean specialises in complex commercial High Court and arbitral disputes. He has a particular focus on banking and finance disputes, and financial fraud cases.

Expertise
Sean acts for sophisticated corporate claimants (including hedge funds, financial institutions and pension funds) in complex financial disputes and fraud work. He presently acts for the 112 financial institutions claiming against Tesco Plc in respect of its £263m accounting mis-statements.

Experience
Sean has recently completed a €500m complex derivatives claim and a £150m civil fraud both with substantial claimant recoveries for our clients. Sean presently leads the Stewarts team acting in the high-profile claims against Tesco Plc.

Sean’s work has widely been recognised by leading legal directories, which say he is “good, smart and always looking for angles to improve his client’s case”, “inspires confidence”,and is “incredibly hard-working”. They have also described him as “a brilliant strategist”, “innovative” and “always on top of the detail”. Sean was one of The Lawyer’s 2008 Hot 100 lawyers.

Sean has regularly appeared in the broadsheet and legal press and appears as a speaker at conferences on financial and shareholder disputes.

Career

Worked in Niigata, Japan,1992-93; trained Baker & McKenzie; qualified 1995; Baker & McKenzie London and Sydney dispute resolution departments 1995-04. In 2004 with a group of Baker & McKenzie litigators, Sean founded niche dispute resolution practice Masseys LLP which was described in the Legal 500 as ‘excellent and noted for its willingness to litigate against banks.’ Masseys merged with Stewarts Law on 2 August 2010.

Stewarts Law LLP¬†advises on large-scale civil fraud matters with cross-border aspects. The firm is advising RAKIA, which invests the sovereign wealth of Ras Al Khaimah; in a fraud case against a former CEO and other individuals valued at $1.5b. It also continues to act for the liquidators of Kaupthing in connection with a ‚ā¨500m claim against Deutsche Bank which related to the sale of banking derivatives during the credit crunch. Clive Zietman¬†heads the team, he is supported by the ‚Äėimpressive‚Äô Sean Upson¬†who ‚Äėtypically identifies very quickly the available courses of action and then provides prompt and reliable advice as to which option is most feasible and appropriate‚Äô. The practice acted for 112 institutional investors, as claimants, in seeking damages further to Tesco's admission that its earlier financial statements were overstated by at least £326m as a result of manipulation of its commercial income; the case is one of the first cases to be brought under new legislation that is designed to address serious corporate mis-statements in published statements.Clive Zietman heads the commercial litigation department and the 'ultra-responsive' Ian Gatt QC 'has a good understanding of clients' priorities'.
