Hoang Phong Anh is a fully qualified Vietnamese lawyer who, prior to joining DFDL in 2007 as the senior associate in charge of the Vietnamese practice, worked for Gide Loyrette Nouel in Vietnam for 12 years.  He has an excellent knowledge of corporate, commercial and investment law in Vietnam, having provided legal expertise on several important foreign investment projects in Vietnam as well as working on donor funded technical assistance projects, including projects for the review and analysis of draft Vietnamese legislation.

Mr Hoang provided legal advice and assistance for several BOT power plant projects for both the sponsor side (a gas-fired BOT power plant project of USD 480M in Vietnam) and the Government side (two coal-fired BOT power plant projects – 1,200 MW, USD 2B each project, and one gas-fired BOT power plant project – 700 MW).

He is the lawyer for the Vietnamese Government in an international arbitration in connection to an investment dispute between an overseas Vietnamese investor and the Vietnamese Government.

Mr Hoang also provided technical assistance to several banking reform projects which were financed by World Bank and Asian Development Bank in Vietnam.

DFDL Legal & Tax's J√©r√īme Buzenet¬†in Ho Chi Minh City advised Impact Investment Exchange - an impact fund - on the provision of a loan to a Vietnamese entity, which necessitated the registration of the loan with the State Bank of Vietnam. He and Hanoi-based¬†Hoang Phong Anh¬†advised Payoneer on various fintech matters. Asset finance, derivatives, and bancassurance are other areas of expertise.

At DFDL Legal & Tax, J√©r√īme Buzenet, who is based¬†in Hanoi, and Huynh Dai Thang¬†in Ho Chi Minh City assisted Affinity Equity Partners with the Vietnamese elements of its purchase of Lock & Lock, which has four subsidiaries in Vietnam. Tran Thi Vu Hanh¬†in Hanoi advised HanesBrands on a restructuring exercise.¬†Other work includes Buzenet and Hoang Phong Anh advising¬†Sumitomo Dainippon Pharma on a change of distributor in Vietnam. Advice to warranties and indemnities insurers on M&A deals is another area of expertise. Air Asia is also a client.

DFDL Legal & Tax's¬†J√©r√īme Buzenet and Hoang Phong Anh advised Qatar Petroleum International on the sale of its share in the Long Son petrochemicals project to Siam Cement. Anh and Martin Desautels, who are active in projects across the region, advise the Ministry of Industry and Trade on various issues concerning the Nam Dinh energy project. As part of a multinational team, the practice advised B. Grimm Power Company, which has a subsidiary in Vietnam, on its IPO in Thailand. Other mandates concern solar energy.

    On 6/20/2012, the National Assembly voted to adopt the Law on Price (the "LOP") in response to the public demand for an effective legal framework to control price manipulation from dominant enterprises such as gasoline, electricity, etc. The law will take effect from 01/01/2013 and repeal Ordinance No. 40/2002/PL-UBTVQH10 dated 26/4/2002 of the National Assembly Standing Committee (the "Ordinance"), which is conceived as outdated and containing certain provisions contravening the WTO’s regulation. This article describes the main features of the law and provides some insight into its potential impacts on the Vietnamese economy.
