Jayne specialises in international arbitration as well as general commercial litigation and mediation covering a wide range of areas. She has written a guide to mediation in the EU (The EU Mediation Atlas: Practice and Regulation) for which she was awarded the CEDR award for excellence in ADR. Jayne co-authored the Simmons & Simmons guide to arbitration, ‘Arbitration Matters’.

Simmons & Simmons' team 'works seamlessly internationally using partners and staff from across the firm's offices'. It regularly acts in arbitration proceedings that involve complex points of law that have industry-wide interest in key sectors such as TMT, financial institutions, energy and infrastructure. The international arbitration group is led by Stuart Dutson, and Jayne Bentham acts in large and complex multi-jurisdictional arbitrations, particularly in the telecoms and energy sectors. Other key advisers are managing associates Basil Woodd-Walker and Minesh Tanna. Simon Morgan retired from the practice in 2018; and Philip Norman, who worked in the firm's Dubai and Doha offices for several years, recently returned to the London office but left for Covington & Burling LLP in Dubai in 2019.

Focusing on investment-state disputes, Simmons & Simmons continues to be actively involved in arbitration proceedings in the telecoms, financial services, energy and infrastructure sectors across Europe, the CIS, Asia and Africa. Stuart Dutson chairs the international arbitration group and has 'very good specialist knowledge of public international law'.   • Failure to counter financial crime: Norwich Union Life

    In December 2007, the Financial Services Authority (FSA) imposed a fine of £1.26m on Norwich Union Life (part of the Aviva Group), one of the largest life insurance businesses in the UK with around seven million customers. The fine related to failures to take reasonable care to establish and maintain effective systems and controls for countering the risks of financial crime. The fine is the latest confirmation of the emphasis being placed on protecting clients and customers from the threat of financial crime.
