Environmental & Regulatory

Head of Environmental & Regulatory

With over 15 years’ experience, Lyn is a specialist regulatory lawyer, focusing on environmental, health and safety, food safety, trading standards and planning law.

Working with Mark Lumley, Head of Commercial, Lyn leads the regulatory team’s provision of a complete advisory and commercial support service to help businesses and those who run them comply with regulatory requirements. This includes:

  • Helping set up and update policies and procedures
  • Training and guidance for compliance officers and directors holding compliance obligations
  • Broader business training and guidance for operational staff that can also be delivered by compliance and training officers

Guidance and support is provided in respect of all aspects of regulatory compliance; Lyn’s work includes:

  • Directors’ duties and responsibilities
  • Environmental, waste and packaging legislation
  • Health and safety
  • Food safety
  • Trading standards
  • Competition compliance

Lyn also assists clients on the increasingly important issue of risk apportionment of environmental/safety liabilities in the context of property and corporate transactions.

Lyn brings an outstanding level of knowledge and commitment to her work, and is the first person clients think of calling when an inspector calls.

Lyn has been recognised by her clients in the legal directories as quite simply “fantastic”. "She has dealt with the issues that we have, and her environmental knowledge and ability to apply it in an appropriate way for our business has been excellent", has said one source. Legal 500 highlights Lyn's "strong personal commitment" to her clients and one impressed source notes: "She cares so much for the client's outcomes and is technically very skilled. She is very easy to work with, has a nice manner and is intelligent and thoughtful.".

Lyn provides reliable and assured representation for clients faced with regulatory enquiries, investigations and prosecutions. Lyn seeks to bring enquiries to a positive conclusion prior to enforcement action commencing.

Lyn was the lead solicitor on the important sentencing guideline case R v Friskies Petcare (UK) Limited.

Whilst Lyn acts for all business sectors, she has significant specialist planning, environmental and regulatory knowledge in relation to mines, quarrying, waste management and complex chemical and manufacturing sites. Lyn has an in-depth understanding of the particular requirements of business operations in those sectors.

Lyn is an acknowledged expert in the requirements of managing chemical site compliance issues.

Past and current clients include several major household names (in the retail, food, waste and manufacturing sectors), as well as upper-tier and lower-tier COMAH sites.

Lyn is regularly invited to speak at conferences organised by high-profile national and regional organisations such as the RICS, IiE (investors in the Environment) and Electronics Yorkshire. Lyn is a regular contributor to trade and compliance publications.

Lyn is a Board Member and a Director of YCF (formerly known as Yorkshire Chemical Focus), and is a convener for its waste and environment group.

    A. INTRODUCTION   The VAT E-commerce Package adopted by the Council on the 5th of December 2017 includes several changes that will be gradually implemented, some changes will be effective as from the 1st of January 2019 and the rest as from the 1st of January 2021.
  • Doing business in Ukraine: turning point for the currency control in Ukraine

One of the most hotly discussed topics in 2019 is currency control liberalization in Ukraine. The currency control liberalization was one of Ukraine’s priorities under the EU-Ukraine Association Agreement. At the beginning of 2019 the National Bank of Ukraine (hereinafter the “NBU”) approved and promulgated all long-awaited regulations, serving as the basis for a new liberal system of foreign currency control. The new currency control system will be launched on 7 February 2019, the same day as the Law of Ukraine  On Currency and Exchange Transactions  becomes applicable. The changes are aimed at deregulation, facilitating cross-border transactions with foreign currency and expanding the list of available foreign currency transactions.
  • New Long Term Residency Visas

After much media coverage, Cabinet Decision 56 of 2018 (the Decision ) has been gazetted which introduces new long term residency visas to, amongst others, four categories of persons in the UAE.
  • Significant Changes to Civil Procedure Code

Significant changes to Federal Law No 11 of 1992 (the Civil Procedure Code ) will soon be coming into effect. These changes are introduced through regulations (the Regulations ) issued under the Civil Procedure Code and will come into effect on 16 February 2019.
  • Merger Clearance Matters

The United Arab Emirates (the UAE ) promulgated legislation to specifically address the regulation of competition (being Federal Law 4 of 2012, or the Competition Law ) several years ago but until recently, it has been the case that the requisite implementing regulations and processes were not in place. This is no longer the case. Not only have the much anticipated implementing regulations been issued, the UAE Ministry of Economy (the Ministry ) (being the regulator in charge of administering the UAE competition regime) has now formed the required committee and issued the anticipated guidance and forms to allow concerned parties to make merger clearance submissions to the Ministry where required to do so pursuant to the Competition Law.
