Position

Charles is a partner with over 20 years' experience in providing regulatory crime advice to corporations and its directors on investigations, prosecutions and other enforcement actions in relation to the offences which can be committed by companies.  These offences can include bribery and corruption, environmental, waste and nuisance, corporate manslaughter, health and safety, trading standards, animal welfare, pricing and promotions, food labelling, food hygiene and food safety, weights and measures, Coroner's inquests, product recall and product safety.

Charles has expertise in all sectors but in particular retail, food and drink, hospitality and leisure, manufacturing, rail, construction, property and facilities management, automotive, government and defence, mining, transport, warehousing and logistics, and healthcare. Charles also and acts for individuals as well as many well-known global and high street businesses.

Acutely sensitive to reputational risk/brand protection issues, Charles routinely acts on high profile matters and is ranked both locally and nationally over many years.  Charles is a regular speaker at seminars and events, a provider of bespoke training for clients and umbrella bodies, a writer of articles on various subjects within his expertise and a reviewing editor of leading textbook Consumer and Trading Standards: Law and Practice.

Shoosmiths LLP's health and safety practice has wide-ranging experience covering non-contentious matters in addition to defending and prosecuting cases on behalf of corporate clients. It is particularly noted for its expertise in the petrochemical, retail, automotive, manufacturing, transport, food and healthcare sectors. In an illustration of its track record in the automotive sector, Philip Ryan acted for a global car manufacturer in a number of health and safety inspections into its UK and European arms, which revealed a number of unsafe practices and a failure to follow appropriate testing of lifting equipment; Ryan provided training to the company and, following written responses provided under caution, the authorities opted to forego any prosecutions. In another key mandate, the practice represented a provider of facilities and constructions workers in a HSE investigation arising from a fatal accident involving a delivery vehicle and a banksman at a construction site in London. Charles Arrand regularly acts for corporations and their directors in health and safety investigations, prosecutions and other enforcement actions.

The practice's workload covers the full range of contentious and non-contentious matters, from environmental due diligence and drafting warranties and indemnities on corporate transactions, to civil and criminal environmental matters including nuisance claims and prosecutions by environmental regulators. Recent highlights include acting for Altitude (Ascot) in a successful appeal agains the refusal to grant planning permission for the redevelopment of a waste processing plant for residential use. The practice also advised Lingfield Properties on the sale of a strategic site at the former Didcot power station to the Diageo Pension Trust, and assisted St Modwen Developments with the environmental aspects of the development and sale of  a £30m railway rolling stock manufacturing facility in South Wales to a Spanish infrastructure company. Charles Arrand heads the practice, which includes compliance and criminal defence specialist Philip Ryan.

  • THE VAT E-COMMERCE PACKAGE

    A. INTRODUCTION   The VAT E-commerce Package adopted by the Council on the 5th of December 2017 includes several changes that will be gradually implemented, some changes will be effective as from the 1st of January 2019 and the rest as from the 1st of January 2021.
  • Doing business in Ukraine: turning point for the currency control in Ukraine

    One of the most hotly discussed topics in 2019 is currency control liberalization in Ukraine.The currency control liberalization was one of Ukraine‚Äôs priorities under the EU-Ukraine Association Agreement. At the beginning of 2019 the National Bank of Ukraine (hereinafter the ‚ÄúNBU‚ÄĚ) approved and promulgated all long-awaited regulations, serving as the basis for a new liberal¬†system of foreign currency control. The new¬†currency control¬†system will be launched on 7 February 2019, the same day as the Law of Ukraine¬† On Currency and Exchange Transactions¬† becomes applicable. The changes are aimed at deregulation, facilitating cross-border transactions with foreign currency and expanding the list of available foreign currency transactions.
  • New Long Term Residency Visas

    After much media coverage, Cabinet Decision 56 of 2018 (the Decision ) has been gazetted which introduces new long term residency visas to, amongst others, four categories of persons in the UAE. 
  • Significant Changes to Civil Procedure Code

    Significant changes to Federal Law No 11 of 1992 (the Civil Procedure Code ) will soon be coming into effect. These changes are introduced through regulations (the Regulations ) issued under the Civil Procedure Code and will come into effect on 16 February 2019.
  • Merger Clearance Matters

    The United Arab Emirates (the UAE ) promulgated legislation to specifically address the regulation of competition (being Federal Law 4 of 2012, or the Competition Law ) several years ago but until recently, it has been the case that the requisite implementing regulations and processes were not in place. This is no longer the case. Not only have the much anticipated implementing regulations been issued, the UAE Ministry of Economy (the Ministry ) (being the regulator in charge of administering the UAE competition regime) has now formed the required committee and issued the anticipated guidance and forms to allow concerned parties to make merger clearance submissions to the Ministry where required to do so pursuant to the Competition Law.
