Dispute Resolution - Finance & Banking Disputes

Position

Mohammed is a senior QC in the Banking and Finance group and specialises in the field of civil fraud, particularly within the banking and financial services sectors.

Mohammed was called to the Bar in 1985 and was made Queen's Counsel in 2006. During more than 28 years of continuous practice he has advised clients from the UK, United Arab Emirates, India, Pakistan and other regions on a wide range of both criminal and civil matters.

As former Standing Counsel for the Department of Trade and Industry, Mohammed has particular expertise in matters involving company and insolvency law, directors’ duties, directors’ disqualification and personal insolvency; all of which often overlap into civil and criminal investigations. His experience encapsulates many aspects of SFO, FCA and other financial regulatory compliance and he has frequently led and managed teams of lawyers, accountants, forensic experts and other professionals as part of an investigatory team.

Increasingly he is asked to advise on banking and finance matters, including aspects of Islamic Sharia Finance Law by financiers and financial institutions keen on developing Sharia compliant banking products.

In addition, Mohammed is frequently instructed to advise in respect of cross-jurisdictional cases, with an emphasis on Dubai and the wider United Arab Emirates, Pakistan, India and the Cayman Islands.

The team defended Maze Sarl against a Commercial Court claim concerning enforcement action taken by VTB, Russia's second largest bank over the majority shares in Vivacom, the largest telecoms network in Bulgaria, such shares being pledged to VTB as security for a €150m loan. Masoud Zabeti heads the finance and banking disputes group; James Oldnall is 'a very able individual'; and Adam Epstein is 'very clever, thoughtful and meticulous in his preparation and running of a case'. Derval Walsh, Mohammed Khamisa QC  and Genevieve Quierin are also highly rated, along with contentious regulatory partner Guy Wilkes, who was hired from Mayer Brown International LLP.

The way we use the internet haschanged. It is no longer merely a digital reference library. As the internet has grown and the amount of information available has expanded, people have developed a new way of accessing this information in a way that is relevant to them. The ‘new’ internet, or ‘Web 2.0’, is a network of relationships where users interact and share knowledge with each other. Virtual friends become the custodians of knowledge, recommending products and services through their blogs and on other social media sites. By seeing what your like-minded friends find interesting, you are better able to decide what information you wish to ‘consume’.
