What do you see as the main points that differentiate [law firm name] from your competitors?

At Bufete Cuetara Canale (BCC) we understand complex litigation causes extreme stress to the client and the heads of the legal areas involved, therefore we always keep a very close and timely communication with all the people involved.

BCC attorneys are very creative and can produce novel and different solutions to complex litigations, being the main reason we were able to get our client (Mazda Motors) acquitted before any other car company in 2020, in a class action filed against almost all the car manufacturers in Mexico.

Which practices do you see growing in the next 12 months? What are the drivers behind that?

In Mexico, class actions are still new and will keep growing significantly in the following years.

On the other hand, due to Covid-19’snegative effect on the economy, we believe many bankruptcies will be filed in the following years, generating a substantial increment in litigation regarding bankruptcy.

Also, the new left-wing government is currently making many changes to policy regarding business regulation, specially in the energy sector, giving private corporations grounds to challenge many new laws, therefore creating many new opportunities for administrative and constitutional litigation in the upcoming months.

What’s the main change you’ve made in the firm that will benefit clients?

The main change we have made is a change in the mentality of all the members of the team. The mindset of the team is to always consider the problems and stress affecting the people within the different corporations, whom are part of the legal departments and responsible for the outcome of the litigation.

Is technology changing the way you interact with your clients, and the services you can provide them?

Absolutely. As a result to the Covid 19 lockdowns, the Courts have switched from personal contact with the parties involved in litigation, to an online contact. As such, our firm can easily represent clients all over the Mexican territory, without having to travel as much, hence lowering costs and expenses involved in litigation.

Also, new technologies are emerging every day, which helps us perform our work faster, resulting in the lowering of legal fees to our clients. In today’s legal market, firms must always be on the lookout for new technologies in order to: a) expedite legal procedures, and b) provide the best quality of legal services with while also procuring to lower the costs involved in litigation as much as possible.

Can you give us a practical example of how you have helped a client to add value to their business?

Whenever a case is concluded, we provide a final analysis to the Client explaining the causes of that specific litigation and the reasons for which the results of litigation were favorable o not to the client, informing the client all the necessary changes that should be made to avoid future similar litigation. In 2020, we concluded litigation and got Pepsico Inc acquitted in a multimillion-dollar trial. In such trial it was quite difficult to obtain an acquittal judgment because the wording of a clause used in the agreement could be interpreted in different manners. As such, we provided a diagnostic and changes were made to other similar contracts.

Are clients looking for stability and strategic direction from their law firms – where do you see the firm in three years’ time?

Our client base is growing at a very rapid pace. One of the challenges our firm will face is to provide the same quality of service to more clients.

Also, after being the only firm in Mexico to win several class actions expeditiously, BCC has positioned itself as one of the top class action firms in Mexico, therefore, the firm will grow in headcount and must be able to transfer the client-service mentality to all the new firm members.
