Practice areas
Bankruptcy and insolvency: Steenson Nicholls has considerable experience in dealing with all aspects of Jersey bankruptcy and insolvency. The firm’s practice extends to advising on asset recovery actions prior to and post insolvency procedures; advising officers and directors on duties and liabilities; pursuing and contesting désastre, dégrèvement and remise de biens applications; and winding up Jersey companies. The firm also undertakes significant cross-border international insolvency work, representing foreign insolvency practitioners seeking recognition and assistance in Jersey both under the statutory regime and pursuant to principles of comity.

Litigation and dispute resolution: Steenson Nicholls undertakes all forms of litigation resolution. In addition to commercial litigation and dispute resolution, the firm has specialism in banking and finance litigation; commercial contract disputes; construction and engineering disputes; debt collection; professional negligence; property litigation; reputational protection/defamation; and shareholder and partnership disputes. The firm focuses on helping their clients to avoid disputes becoming litigious wherever possible. The firm works with their clients to manage disputes in a way which identifies and analyses the risks, optimises the pressure points, and seeks out the opportunities for resolution, with the objective of cost effectively meeting the desired commercial outcome.

Compliance and regulatory disputes: The firm has a wealth of experience in dealing with Jersey compliance and regulatory matters. The firm’s work  includes advising and assisting in connection with AML/CFT & reporting obligations; anti-bribery and corruption investigations; customer due diligence; data protection; on-site-examinations; licence applications; remediation projects; and responding to “no-consent” informal freezes. The firm also advises on corporate governance and risk management issues and regularly represents clients in connection with the JFSC’s decision-making process.

Contentious trust: Steenson Nicholls’ act in some of the most complex, high value trust litigation in Jersey. The firm acts for trustees, beneficiaries, protectors of Jersey trusts and foundations in connection with breach of trust claims; constructive trust claims; knowing assistance claims; trustee applications for directions; Public Trustee v Cooper applications; trust administration disputes; applications to remove/appoint trustees; applications for the disclosure of information; fee disputes; proceedings/investigations brought by HMRC and other foreign revenue agencies; and tax information exchange agreement appeals.

Employment law: Steenson Nicholls advises on all aspects of Jersey employment law and has experience dealing with the full range of employment issues including claims for unfair dismissal; claims for constructive dismissal; claims for breach of contract; and claims for enforcement of restrictive covenants. The firm regularly advises employees in relation to compromise agreements following the termination of employment.

Fraud and asset recovery: Steenson Nicholls has almost unparalleled experience in pursuing and defending international fraud claims and asset recovery proceedings, representing clients in many landmark and high-profile cases. The firm handles the regulatory, data protection, intellectual property, governance, human resources, and loss recovery issues which arise from fraud, whether involving employees, suppliers, business partners or others. The firm has considerable experience in obtaining injunctions, including freezing orders, disclosure of information orders, notification orders, orders for the delivery up of assets or wrongly retained confidential information, as well as search and seizure orders. The firm’s practical experience extends to asset tracing claims; freezing and disclosure injunctions; Norwich Pharmacal orders; search and seize orders; civil fraud claims; fraudulent breach of trust claims; and civil confiscation and forfeiture proceedings.  The firm has recently acted in some of the most high profile cases brought pursuant to Jersey’s recently enacted civil forfeiture regime.
