Recent filings: In 2020-21 we have filed over 500  applications before the Trademarks, Patent, Copyright, Designs office , 130+ litigation cases for passing off, trade mark, copyright and Patent infringement, unfair competition, damages etc.  Additionally, we instituted 100 litigation cases and 175+ opposition, cancellation matters for a diverse range of clients.  We also manage a portfolio of over 1400 Patents.

IP practice specialisation: RNA provides complete range of IP services, from clearance searches to filing and prosecution of trademark application in India, India sub-continent, Trademark transactional work, Trademark enforcement, oppositions and rectifications and IP strategy.

Our prosecution team provides full range of trade mark and patent management services, from, strategizing, trade mark and Patent clearance, prior art searches and freedom to operate and landscape studies to harvest innovation for our clients.

Our trademark services cover complete transactional work from conducting due diligence in mergers and acquisitions and IP audits to drafting and negotiating licensing and franchising agreements. We have developed expertise in filing and prosecuting international applications through the Madrid protocol for our local as well as global clients.

Our enforcement team comprises lawyers, researchers, and investigators that have both in-house and private practice experience. Our team is trained to devise strategies to find business solutions to IP legal issues. In the last 10 years, our team has handled over 750 civil actions and more than 1000 criminal actions working with local police. Our team is experienced in handling one-off infringements and devising a comprehensive enforcement campaign to create impact at both the manufacturing and distribution end. We work closely with businesses in understanding their priorities, distribution network, trade channels, and factors that affect their trade to devise enforcement campaigns that address both online and brick and mortar sales. We regularly advise clients on the most germane court for filing legal action and whether or not  civil or criminal option would be a viable option alongside provide individualized case management services at all stages of litigation. Additionally, we have worked on numerous online infringement issues and have several on-going cases on digital issues and specific to e-commerce portals.

RNA has developed a software (which we call Brand Protection Cop) to check e-commerce portals for identifying parties selling fake/counterfeit products. The cases instituted by us have a success rate of 90% in interim injunctions and final judgments.

The team at RNA worked closely with brand owners even during the lock down due to Covid 19 pandemic and handled interesting pharmaceutical court cases during this phase obtaining injunction orders and conducted successful raid actions resulting in seizure of huge quantity of infringing goods.

1. Assisting Manzil Mystics a Delhi based registered non-profit (Trust) for

    • securing copyright registration for their song/ musical track titled ‘Awara’.
    • filing the Design application for protecting the design of Mobile recording studio. The studio is designed on the concept of classroom in the bus.

Manzil Mystics works for disadvantaged sections of the society by holding workshops on Gender education, Spoken English, Reproductive health, Menstrual hygiene, and Life skills through music in less privileged partner schools and communities. They also organize community events centered on socially conscientious music and produce music (writing, composing and recording) for schools, colleges, NGOs and corporates.

2. Arpan – Arpan founded in 2006 provides for a long-term psychotherapeutic support to adolescent girls and boys and adult survivors in shelter homes who have been sexually abused or trafficked and provides healing support to children and adult survivors of Child Sexual Abuse through Mental Health Services. Since its inception in 2006, Arpan has directly imparted lives of over 245,095 children and adults through prevention, healing and training programmes. We advised and assisted them in filing and prosecuting their 15 copyright applications in English, Hindi and Marathi Language.

3. Cividep – Cividep is engaged in empowering workers and communities and to ensure that businesses comply with human and labour rights and environmental standards. We reviewed the video film prepared by Cividep that was intended to be shared via its YouTube channel and website. The film was analyzed it taking into account the relevant enactments such as The Advertising Standard Council of India Code, Information Technology (Guidelines for Intermediaries And Digital Media

Ethics Code) Rules, 2021, The Cable Television Networks (Regulation) Act, 1995 and Cable Television Networks Rules, 1994, Foreign Contribution Regulation Act, 2010.
