Career

David specialises in all aspects of non-contentious intellectual property, with particular emphasis on computer-related contracts and issues. He advises on all types of commercial contract, particularly those with an international flavour or requiring cross-disciplinary expertise.

He is a recognised authority on Competition Law and also advises on all aspects of EU law. He is the author of the European Competition Law section of the Stair Encyclopaedia.

David is also a licensed insolvency practitioner and authored MacRoberts’ Scottish Liquidation Handbook as well as other texts on insolvency.

He is Chair of the American Bar Association Committee on Intellectual Property law, and writes and lectures in the UK, the US and internationally on his areas of expertise.

MacRoberts LLP's David Flint, who has nearly 40 years of competition law experience, leads the team, which advises public and private sector clients on competition law compliance, merger control, cartel and other regulatory investigations, and public procurement. It generates mandates from clients in sectors such as construction, food and drink, publishing and transport, among others. Duncan Osler, who is accredited by the Law Society of Scotland as a specialist in public procurement law, undertakes a significant amount of work for clients such as government bodies, NHS boards and local authorities. John Reid departed for an in-house role at Scottish Power.

MacRoberts LLP handles the spectrum of public law issues, including monitoring legislation proposals and advising on their legal implications, drafting and vetting briefing papers and advising on parliamentary and judicial procedures for challenges to proposed legislation. The group is led by Duncan Osler who advised NHS Orkney on Scottish Government issued guidance on the application of the ESA10 accounting standards in relation to project finance. He also advised ReadyForBusiness on new developments in Scottish procurement legislation in relation to mechanisms through which public and third sector bodies work together. David Flint is recommended for his experience in lobbying, FOI requests and experience in appearing before the Public Petitions Committee of the Scottish Parliament.

MacRoberts LLP handles a mixture of IT procurement, managed service agreement, hardware supply, service-level agreements and GDPR advice. The group is led by David Flint who has particular expertise in encryption and technology policy issues. Flint assisted Fidra Software with on-licensing to UK and international customers. David Gourlay specialises in large outsourcing projects in both the public and financial sectors. He is currently advising the Digital Directorate of the Scottish Governmnet on the second phase of its CivTech project. Julie Hamilton advised the Executive Agency of the Scottish Government on its ongoing Court of Session commercial action against a global IT contractor arising from the termination of a contract after the contractor’s default.
