Partner in litigation unit specialises in commercial litigation and insolvency. Commercial litigation – broad range of commercial disputes; area of practice extends to a wide variety of contractual disputes, debt recovery, actions for interdict, breach of fiduciary claims, evictions, shareholder disputes, intellectual property issues; works closely with the employment unit advising and litigating over restrictive covenants, confidential information and other employment contract related issues. Has represented clients in appeals in property-related litigation; regularly instructs junior and senior counsel for a variety of Court of Session work; advises clients on disputes over intellectual property rights; significant experience in Court of Session Section 1 Administration of Justice Act Petitions (Dawn Raids). Recent outer house actions include complex intellectual property disputes involving the instruction of forensic IT experts. Recently acted for clients pursuing a multifaceted Court of Session action for specific implement and damages, requiring the instruction of numerous experts in fields including landfill construction, pollution migration, the movement and migration patterns of fish and quantification. Experienced in alternative dispute resolution and has recently completed two high-value mediations. Insolvency – focuses on acting for insolvency practitioners in formal appointment work, an advisory capacity, debt recovery, and in contentious dispute work. Also works closely with colleagues in other commercial units advising and litigating on behalf of creditors against insolvent businesses. Currently in the lead role, acting for the trustee, one of Scotland’s largest property fraud sequestrations, pursuing numerous Court of Session actions involving actions for proving the tenor, unjustified enrichment, and issues of adoption of forgery, mora taciturnity and acquiescence. Recently took the lead in an inner house appeal acting for an IP. Acts for defenders being pursued by their former company in administration. High-value Court of Session commercial action. Includes allegation of breach of directors duties and fraud on creditors concerning international property investments and construction projects.
