Position

A Partner in the Real Estate Dispute Resolution team, Rachael advises on the full range of contentious property issues, with a particular focus on restrictive covenants and co-ownership and trusts of land disputes.  Rachael also advises on both commercial and residential property and landlord and tenant litigation, including property related negligence, possession claims for commercial and residential premises, disrepair and other breaches, forfeiture, service charge issues, exercise of break options, trespass and nuisance claims, dilapidations and boundary disputes.

Spearing Waite LLP combines ‘great service’ with ‘excellent advice’ and is particularly active for national retail clients, especially in landlord and tenant disputes, but also undertakes work for property developers and investors, house builders, charities and high-net-worth individuals. While Michael Lawrence left the firm, new practice head Rachael McConaghie joined from Sherrards Solicitors LLP and recently led advice for a retail client on a claim against a landlord following the release of asbestos in one of its stores as a consequence of ceiling repair works.
