Managing Partner

Position

Philip is the firm's Managing Partner. He took up his role on 1 April 2018 having been a Partner with the firm since 1994. He is responsible for the efficient running of the day-to-day business and the firm’s client strategy.

Prior to this, Philip was head of our Commercial Litigation team and he continues to practise in commercial and real estate litigation with an emphasis on high value contractual and professional negligence claims. He has an impressive track record of representing clients in disputes at all levels of the judicial hierarchy including the Supreme Court and Court of Appeal which is reflected in the number of his reported cases. He is also experienced in arbitration, adjudication and mediation proceedings and employs his negotiation skills to resolve disputes where appropriate.

The team at BrookStreet des Roches advises clients on a broad range of complex litigation matters, with recent highlights including breach of contract claims, professional negligence claims, insolvency litigation and commercial litigation for real estate clients. Philip Shaw heads the team, with 30 years’ experience as a commercial litigator under his belt. Shaw and associate Gemma Tolmie are continuing to act for Smeg in a cross-jurisdictional contractual dispute with its former Irish distributor NAA and are representing The Beaming Smile Company in a professional negligence claim against the client’s former solicitors, together with senior associate Simeon Fenn. Senior consultant Peter Moody] specialises in the hospitality and leisure sector and advises clients in the technology, offshore, finance and transport sectors.

The property litigation team at BrookStreet des Roches is 'a pleasure to work with', providing 'well-informed, conscientious advice that takes into account clients' needs and anticipates how they would wish to proceed in a given situation'. The practice is particularly singled out for its retail sector expertise, where clients include Arcadia Group and McDonald's, among other prominent retail brands. It also acts for a sizeable roster of investment clients, as well as high-net-worth individuals and charities clients. The practice is acting for Arcadia Group and The Body Shop International in a number of high-value central London lease renewals, which involves handling oppositions to the renewals on the grounds of redevelopment. It also acts for The Beaming Smile Company in a professional negligence claim against the client's former solicitor concerning two commercial lease renewals. Katy Kirk heads the practice and is 'very proactive and highly motivated'. Philip Shaw is also recommended.
