Career

Alain Orengo is a Partner in the Professional Indemnity and Financial Risks team based in the London office and has been with Plexus for over 19 years. Alain’s principal area of practice is insurance and the defence of professional indemnity claims, and professional regulatory disputes or disciplinary inquiries before the Solicitors Disciplinary Tribunal, Royal Institution of Chartered Surveyors and Institute of Chartered Accountants in England and Wales. Alain acts for major insurers and their insureds and has extensive experience in defending claims against a range of traditional professions, including solicitors and conveyancers, commercial and residential surveyors and valuers, estate agents, managing agents, auctioneers, building surveyors, accountants and insurance brokers. Alain also regularly acts for ‘new professions’ including health and safety consultants, playground inspectors and costs draftsman.

Alain has defended numerous claims brought against surveyors and valuers, and solicitors by banks and financial institutions arising out of alleged negligent residential and commercial valuations and property transactions, often also involving allegations of fraud and deceit.

Alain also advises insurers on policy coverage involving professional indemnity insurance, including minimum terms, issues arising from claim/circumstance notification clauses, excess and limit of indemnity aggregation, various exclusion clauses, material non-disclosure/misrepresentation and avoidance. Alain also has significant experience of, and has recently been involved in, arbitrations involving policy disputes.

Alain also handles claims (including subrogated claims) arising from property damage, including fires, explosions, floods and subsidence, as well as associated business interruption.

Alain has extensive litigation experience in all divisions of the High Court involving complex and high-value claims. Alain also regularly acts as advocate in mediations and is an effective negotiator. Alain has conducted many mediations and has an established record of success with a reputation for being robust, whilst also taking a common-sense and pragmatic approach to commercial dispute resolution. Alain is recognised as “very experienced, has an uncanny knack of being able to call a case correctly, and is a brilliant negotiator.
