The firm

The firm was initially created in 1997 and was motivated by the fostering exchange and cooperation between French and German industrial sectors. The aim was put the law and its instruments to the service of the communication between spheres which do not necessarily have much in common. Later in 2007, the founding partner, Dr. Florian Endrös, initiated a spin off from the initial firm, thus creating, together with three partners, Muriel Mazaud, Marguerite de Vaublanc and Myriam Bennaim, the firm at its current form. The purpose was to modernize the firm and turning it into a dynamic, innovating law firm, which offers tailored services to each client and provides them with the most efficient solutions. Since 2007 two new bilingual partners, Céline Lustin-Le Core and Tim Jakobs, enforced EBA's constantly growing team. In 2010 EBA opened a branch office in Munich asserting and strengthening its international involvement.

From its beginnings, EBA has chosen to specialize, in particular, on product liability and industrial risk and developed over the years an extensive experience in handling complex industrial cross-border matters (especially, but not limited to, French and German matters), which implies to take the legal as well as the cultural and linguistic specificities of each country into account. Nowadays, the firm counts 15 lawyers, who are all at least trilingual and work in different languages on a daily basis. The firm accompanies mainly international insurers and companies from various industrial sectors, namely automobile industry, health sector, medical devices, solar industry, power plants etc.

Areas of practice

EBA is best known for its expertise in product liability and industrial risk, for its specific knowledge of the various proceedings, specific to this area of law (i.e. expertise proceedings) and of the complex private internal law issues often raised by these type of matters (competent jurisdiction / applicable law). The specificity of this practice area is that the lawyers have to go beyond a pure legal thinking and to combine it with a scientific, technical approach. In this respect, EBA works closely with experts, specialized in the relevant field. Over the years EBA established a great network of experts in different fields (electricity, automobile industry, medical devices, construction, aviation - more specifically helicopters - heavy industry etc.).

Most of EBA's work for insurance companies consists in advising and representing insurance companies in proceedings in which a claim has been made against their insured mostly in the area of product liability and industrial risk. In those matters, EBA is either representing both the insurance company and the insured or solely the insurance company. EBA has an extensive expertise in handling these delicate situations (as there is sometimes a fine line between the interests of the insurance company and the insurer). EBA is coordinating the communication between all actors and ensure that its clients' interests are protected in the best possible manner.

In terms of International Arbitration, EBA deals with cross-border cases mainly involving Product Liability and Industrial Risk issues, in which it represents international and national businesses and/or insurance companies.

  • The new French regulation applying to national insurance contributions for managers and shareholders

    French insurance contributions on executive and shareholder remuneration (pay + dividends) have been substantially increased by the National Insurance Funding for 2013 Act, No. 2012-1404, of 17th December 2012. Until 31st December 2012, all dividends were subject to national insurance contributions on unearned income but henceforth, under Article L136-3 of the National Insurance Code, amended by Act No. 2012-1404, certain dividends   are considered as pay received by executives and shareholders and are therefore subject to the national insurance contributions on pay. The Act also abolished the ceiling on health insurance contributions payable by the self-employed and all this means that businesses must rethink the way that they have been structured until now.
