Advises businesses across all sectors on the full range of commercial contracts, but specialises in technology matters. She therefore advises on contracts relating to both intellectual property and IT issues both nationally and internationally. Joanne advises on all types of commercial agreement, but specialises in high-value, complex master service arrangements and putting together suites of documentation. She also provides specialist advice in relation to IT contracts, including licensing arrangements, software as a service, managed services, cloud arrangements, connectivity arrangements, data location and co-location agreements, data licensing and outsourcing. Advises on regulatory and compliance issues governing e-commerce and data protection and has been involved in carrying out data protection audits and building compliance programmes and drafting agreements to ensure compliance with the regulatory regime, including ensuring the compliant export of personal data. In IP, Joanne advises on ownership issues related to IPR and getting a return on investment through licensing. She also advises on branding strategy, including putting together international filing strategies.

Irwin Mitchell's recent work has included advising National Grid Plc on contracts related to its online training portal (among various other matters) and assisting Saga Plc with the procurement and customisation of a booking and reservation platform. Gatwick-based Daniel Hedley specialises in IT-related matters, such as software licensing and development, cloud services and IT outsourcing. National practice head Stuart Padgham , solicitor Michael Camps and senior associate solicitor Aurelia Butler-Ball (a specialist in the media and entertainment sector) are also located in Gatwick. Laurence Gavin in Sheffield handles a wide range of matters for clients in sectors such as education and charities, as well as the public sector. Joanne Bone, who leads the team in Leeds, complements her commercial contracts experience with knowledge about data protection issues. Birmingham-based Sarah Riding advises clients on matters such as market entry, supply chain management and sponsorship.

In a recent highlight, Bone advised Lowell Group on data protection and GDPR compliance issues; she also assisted Lhasa with the drafting and negotiation of international licensing terms and acted for ResearchBods Online on the drafting of IT contracts for multiple online access panels and platforms. Navigating the minefield of data export

European businesses have always needed to tread carefully in relation to exporting personal data outside the European Economic Area (EEA). This has never been more true than recently when data export became the biggest issue in data protection. The cat was set among the pigeons in October 2015 when the European Court of Justice (ECJ)invalidated the export of personal data to the US via safe harbour and has been shrouded in uncertainty ever since. The Commission’s new deal on ‘safer harbour’ with the privacy shield has not provided the certainty hoped for and many businesses and lawyers are left scratching their heads as to what they can now do and not do.
