Position

Partner specialising in all aspects of French and EU competition law and regulatory with a specific focus on state aid, complex merger control and antitrust litigation. He advises both French and international clients in a broad range of sectors, including regulated industries such as transport, telecom, financial services and energy.

He has recently advised LA POSTE and various public operators on State aid issues, in particular in the context of the COVID-19 crisis; SNCF on issues regarding the transposition of the Fourth Railway Package as well as on State aid issues, in the context of the reform of the French railway system undertaken by the French government; France’s main banks on litigation proceedings before the European Court of Justice against a series of ECB decisions imposing undue prudential requirements and on administrative proceedings before the French regulator in relation to the implementation of the Eurosystem’s monetary policy and intra-day credit. He has also advised an interested third party in the context of the pending Fincantieri/Chantiers de l’Atlantique Phase 2 merger review before the European Commission; Thales as an interested third party competitor in the context of the Siemens/Alstom merger review before the European Commission; Carrefour on its joint purchasing alliance with Système U in the mass retail sector and CMA CGM on various cooperation and contractual schemes.

He is cited as a “leading individual” in the Legal 500 EU Competition and Distribution section.

Career

Prior to founding BDGS Associés in April 2013, he worked at the Inspection Générale des Finances (1993-1997). He then took up the post of Deputy Secretary General of the Economic and Finance Committee of the European Union (1997-1999) and Advisor for economic and industry affairs in the office of Pascal Lamy at the European Commission (1999-2002). From 2002 to 2007, he was a partner at Gide Loyrette Nouel’s Brussels office before becoming Deputy Director of the Prime Minister’s cabinet (2007-2010) and Deputy Managing Director of the Caisse des Dépôts (2010-2012). He co-heads the Competition & Regulatory department with Maria Trabucchi.

The nine-lawyer practice advises leading companies from various sectors, including high-profile banks, state-owned companies and retailers. The team has excellent merger control expertise and recently advised on several of France’s most high-profile M&A deals and other strategic alliances. It notably assisted La Poste and La Banque Postale with the merger control aspects of La Poste’s take-over of CNP Assurances. On the antitrust front, the team is involved in several major domestic cases. The group’s ability to handle complex matters involving the public sector, such as state aid cases and EU law regulatory issues, is another key asset and allowed the practice to notably represent France’s main banks in a dispute brought before the European Court of Justice concerning a series of European Central Bank’s decisions and other EU regulatory issues. BDGS Associés has a strong name for corporate and shareholder conflict cases involving leading corporations, regularly advising on some of France’s most sensitive cases in this area.  It is notably representing Canal+ in a high-stakes dispute with Tf1 regarding broadcasting channel remuneration issues. The team also has very good knowledge of French discovery procedures (article 145) and trade secret issues, while also handling some criminal matters and advising clients on international sanctions. Practice head Kyum Lee is highly recommended, as is Antoine Gosset-Grainville , who is regularly retained by banks to lead strategic cases before the CJEU.

BDGS Associés est recommandé pour sa forte expertise dans la gestion des conflits d’actionnaires et des litiges de droit des sociétés, impliquant de grands groupes leaders. Le cabinet est en charge de plusieurs affaires emblématiques dans ces domaines. En matière commerciale, il a représenté Canal+ dans un litige à forts enjeux, l’ayant opposé à TF1 et portant sur des problématiques de rémunération de droits de diffusion. L’équipe possède également une très bonne connaissance des procédures de saisies selon l’article 145 du CPC et des questions se rapportant au secret des affaires. Enfin, elle traite des dossiers de droit pénal des affaires et conseille ses clients en matière de sanctions internationales. Kyum Lee, qui est responsable de la pratique, est hautement recommandé.
