Position

As a partner specialising in dispute resolution, Ms. Cosar has extensive experience in high profile arbitrations representing public and private clients before ICC, ICSID, LCIA and AAA tribunals. Her recent experience includes representing a pension fund in an ICC arbitration involving a post acquisition dispute and related damages claims. She represented the state in three ICSID arbitrations brought under the Energy Charter Treaty. In addition, she has acted as counsel in various ICC arbitrations, including a construction dispute for delay and damages claims, and two energy projects involving lost profit claims. Ms. Cosar is also an expert litigator, skilled at representing foreign and Turkish clients before Turkish courts. Her recent litigation experience includes representation of a major international company in the energy sector regarding its power plant investment and representation of a leading bank involving damages claims arising out of fraudulent transactions.

Career

Ms. Cosar is admitted in New York and Turkey. She serves on the editorial board of ICC Dispute Resolution Journal and Dispute Resolution International, the journal of the Dispute Resolution Section of the IBA. She is also a member of the Drafting Committee for the International Council for Commercial Arbitration (ICCA) Drafting Sourcebook and the ICCA Publications Advisory Board. She is the author of multiple publications, most recently “Claims of Corruption in Investment Treaty Arbitration: Proof, Legal Consequences and Sanctions” in ICCA Congress Series No. 18, 2015; “Annex ID to the Energy Charter Treaty: Limitation on Consent to International Arbitration” in The Turkish Commercial Law Review 1(1), February 2015; and “Case Comment: Kilic Insaat v Turkmenistan” in Dispute Resolution International 8(2), October 2014. Ms. Cosar also authors Turkey's chapter in Freezing and Attaching Assets (Kluwer Law International); the IBA Arbitration Guide, Privilege and Confidentiality (IBA); International Mergers – The Antitrust Process (Sweet & Maxwell); Global Arbitration Review – European and Middle Eastern Arbitration Review; and Global Arbitration Review Litigation Know-How online publication.

Cosar Avukatlik Burosu specialises in M&A, construction and energy-sector litigation and arbitration. It has experience in representing clients in disputes in UK and US courts as well as the European Court of Human Rights. Recent cases include a dispute over the breach of a software license and support agreement, a shareholding rights dispute, an international commercial arbitration subject to ICC arbitration rules and the wrongful termination of a joint venture agreement.
