Keskin & Keskin has represented a well-known Turkish client throughout a highly complex criminal investigation and settlement procedure in Switzerland. The Firm played a leading role during the negotiations and the conclusion of the very particular and rare multiparty settlement agreement.

The proceeding was launched in 2015: two independent wealth managers wanted to mask a trading loss with unauthorized transactions. The custodian bank was of the largest banks in Switzerland, which notified authorities after a client-raised alarm.

Along with 22 other damaged parties, multiple companies and accounts of the Client were involved to these operations by way of forged instructions and other forged documents. A significant loss, as high as 300 million US dollars, were caused in a fraudulent way and freezing of all assets possibly related to the facts under investigation, whether belonging to the suspects, to the damaged parties/plaintiffs, or to third parties was ordered by the Prosecutor as a conservative measure. The Firm actively participated to the examinations and conducted the dialogue process with the Prosecution and the other plaintiffs.

In 2019, a settlement agreement was reached between the Settlement Agent and the damaged parties, with the active participation and efforts of the Firm. By way of this settlement agreement, a significant part of the plaintiff’s losses are compensated.

The Firm cooperated with other firms from Switzerland, Dubai, London, Netherlands, Gibraltar, Luxembourg and British Virgin Islands throughout the settlement process.
