EU and competition Tier 1
bpv Hügel specialises in merger control, antitrust and international cartel defence work. Practice head Astrid Ablasser-Neuhuber advised a real estate company on complex capital markets, merger control and antitrust issues stemming from a takeover involving the two other leading Austrian real estate companies, and represented the Austrian Association for the Wood Industry in a third-party intervention in the largest Austrian merger of office furniture companies. Ablasser-Neuhuber and Gerhard Fussenegger, the co-managing partner of the firm's Brussels office, are also advising Axel Springer on all its competition and merger control proceedings in Austria. Antitrust litigation expert Florian Neumayr and Christian Schneider, who specialises in EU law, are also key members of the team. The practice's blue-chip client base also includes A1 Telekom Austria, Raiffeisen Ware Austria and Verbund.
Handling the full spectrum of corporate and M&A work, bpv Hügel benefits from its strong tax practice, which it is able to call upon to advise on matters involving tax structuring and tax reorganisation issues. Christoph Nauer advised Immofinanz on the sale of its approximately 26% stake in CA Immobilien Anlagen to Starwood Capital, and Elke Maria Napokoj assisted International Airlines Group and Vueling Airlines with the intended takeover of Niki Luftfahrt; while the clients' bid was unsuccessful, it led to a follow-on mandate where the team assisted the client with the set-up of Austria-based new airline Level. Thomas Lettau, Florian Gibitz and Stefan Gaug are other key members of the team.
Tax Tier 2
Companies, including several blue-chips and energy sector players, and high-net-worth individuals alike routinely instruct bpv Hügel's 'very responsive, experienced and dedicated' team to assist with corporate and transactional tax law matters alongside estate planning, private foundation and contentious matters. The 'hardworking and structured' Kornelia Wittmann, who made partner in July 2018, is a key name for contentious work. Other key individuals include Christoph Nauer and Walter Loukota, who joined the firm in May 2017 from Binder Grösswang, and jointly heads the team with the 'highly efficient' Gerald Schachner, who is 'an outstanding tax lawyer and negotiator with brilliant knowledge and a high level of commitment'.
The 'competent' Christian Schneider, who is noted as 'a specialist in his field', leads the practice at bpv Hügel, which advises on energy, telecoms, healthcare, municipal and environmental law, with a particular focus on planning and zoning and waste management. The team's clients include a number of municipal bodies and energy companies; among other matters, Schneider is representing Kelag and Gas Connect Austria in a dispute with the Chamber of Commerce and Federal Workers Chamber regarding the calculation of gas tariffs, and assisting the city of St Pölten with funding guidelines for investments by new enterprises. The team is also advising British American Tobacco on tobacco regulation. Other clients include the Association of Natural Gas Undertakings (Fachverband Gas Wärme) and A1 Telekom Austria.
Private client Tier 3
bpv Hügel’s private client practice group focuses on advising high-net-worth individuals on tax matters and corporate succession in the context of private foundations and trusts. Another area of expertise is inheritance law, including the drawing up of wills. Florian Plattner is the main point of contact.
Capital markets Tier 4
With a particular focus on ECM, bpv Hügel regularly advises issuers and underwriters on public offerings of shares and private placements, while also handling delistings. Christoph Nauer advised Immofinanz on its reverse stock split at a ratio of 10:1, combining ten existing shares into a single share. Autobank is also a client. Elke Maria Napokoj heads the team, which works in close co-operation with its corporate group.
